Temyiz incelemesinde Temyiz Kurulu hem D1 hem de D2\u2019nin bulu\u015f basama\u011f\u0131 Problem-\u00c7\u00f6z\u00fcm yakla\u015f\u0131m\u0131 a\u00e7\u0131s\u0131ndan uygun ba\u015flang\u0131\u00e7 belgeleri oldu\u011funu de\u011ferlendirmektedir. Her iki belgeden herhangi birinin ba\u015flang\u0131\u00e7 belgesi olarak al\u0131nmas\u0131 durumunda tart\u0131\u015fma konu hakk\u0131nda uzman kimsenin bir h\u0131z sens\u00f6r\u00fc test cihaz\u0131n\u0131n farkl\u0131 bile\u015fenlerini tek bir muhafaza i\u00e7inde tasarlamay\u0131 ger\u00e7ekle\u015ftirip ger\u00e7ekle\u015ftirmeyece\u011fi \u00fczerine d\u00fc\u011f\u00fcmlenmektedir.<\/p>\n<p>Temyiz Kurulu\u2019nun yaz\u0131\u015fmas\u0131na cevaben temyiz sahibi revize edilmi\u015f istem setlerine sahip ana ve 1-4 aras\u0131 terditli taleplerine ek olarak 5. bir terditli talep dosyalar. S\u00f6zl\u00fc duru\u015fma s\u0131ras\u0131nda ise temyiz sahibi ek bir terditli talep (6) daha dosyalar. A\u015fa\u011f\u0131da ana talepte yer alan ana istem bulunmaktad\u0131r:<\/p>\n<blockquote><p>&#8220;A self-testing speed sensor (10) comprising:<br \/>\na sensing element (28) configured to sense a motion parameter of an object (12), the sensing element (28) being a Hall-effect sensing device or a magneto resistive sensing device:<br \/>\na signal conditioning device (30) in communication with an output of the sensing element, the signal conditioning device configured to generate a motion signal related to the sensed motion parameter of the object;<br \/>\na magnetic induction device (26) configured to induce a magnetic field upon the sensing element (28) to simulate the motion parameter of the object (12); and<br \/>\na driving circuit (24) configured to supply the magnetic induction device (26) with a periodic signal causing the magnetic induction device to induce a periodic magnetic field upon the sensing element (28);<br \/>\nwherein, when the periodic magnetic field is induced upon the sensing element (28), the signal conditioning device (30) is further configured to generate an operability indication signal indicating the operability of the sensing element; and\u00a0<b><u>characterised in that<\/u><\/b>:<br \/>\n(a) the operability indication signal is generated independently of the presence of the object (12), and<br \/>\n(b) the sensing element (28), the signal conditioning device (30), the magnetic induction device (26), and the driving circuit (24) are all contained in a housing (18).&#8221;<\/p><\/blockquote>\n<p>Temyiz sahibi D1 varken D2\u2019nin asla bir bulu\u015f basama\u011f\u0131 incelemesi ba\u015flang\u0131\u00e7 belgesi olarak kullan\u0131lamayaca\u011f\u0131n\u0131 belirtmi\u015f olsa da Temyiz Kurulu D1\u2019in uygun bir ba\u015flang\u0131\u00e7 belgesi olarak biliniyor olmas\u0131n\u0131n D2\u2019nin ba\u015flang\u0131\u00e7 belgesi olarak kullan\u0131lamayaca\u011f\u0131 anlam\u0131na gelmedi\u011fi gerek\u00e7esiyle bu g\u00f6r\u00fc\u015f\u00fc reddetmi\u015ftir.<\/p>\n<p>Temyiz Kurulu ba\u015flang\u0131\u00e7 belgesinin tespit edilme ko\u015fullar\u0131n\u0131 bu nedenle iki farkl\u0131 kriter alt\u0131nda incelemi\u015ftir:<\/p>\n<blockquote><p>i) Bulu\u015fa g\u00f6re belirli bir pratik uzakl\u0131kta olan ve bu y\u00fczden en yak\u0131n olmas\u0131na kar\u015f\u0131n kendisi d\u0131\u015f\u0131nda di\u011fer t\u00fcm \u00f6nceki teknik yay\u0131nlar\u0131na g\u00f6re bulu\u015fa daha yak\u0131n nitelikte olan yay\u0131nlar,<\/p>\n<p>ii) Bulu\u015fa kar\u015f\u0131 baz\u0131 ba\u015fka yay\u0131nlarla birlikte ayn\u0131 teknik probleme \u00e7\u00f6z\u00fcm buldu\u011fundan en yak\u0131n belge stat\u00fcs\u00fcnde kabul edilecek yay\u0131nlardan herhangi biri olan yay\u0131nlar.<\/p><\/blockquote>\n<p>Temyiz sahibi ayr\u0131ca D1 kar\u015f\u0131s\u0131nda sadece (b) \u00f6zelli\u011finin de\u011fil (a) \u00f6zelli\u011finin de bir fark unsur olarak kabul edilmesi gerekti\u011fini ifade eder. D2 farkl\u0131 komponentlerin tek bir muhafaza alt\u0131nda birle\u015ftirilmesini \u00f6neren bir yay\u0131nd\u0131r. D2 ayn\u0131 zamanda h\u0131z \u00f6l\u00e7\u00fcm\u00fc i\u00e7in kendi kendine test yapabilen bir cihaza ili\u015fkin oldu\u011fundan D1\u2019den ba\u015flayarak konu hakk\u0131nda uzman kimsenin inceleyece\u011fi konusunda Temyiz Kurulu\u2019nun \u015f\u00fcphesi bulunmayan bir yay\u0131nd\u0131r. D2 farkl\u0131 bile\u015fenlerin tek bir muhafaza alt\u0131nda tasarland\u0131\u011f\u0131nda elde edilecek avantajlar\u0131 a\u00e7\u0131k bir \u015fekilde anlatmaktad\u0131r.<\/p>\n<p>Temyiz Kurulu bulu\u015f basama\u011f\u0131 problem-\u00e7\u00f6z\u00fcm incelemesinde en yak\u0131n belge ister D1 olarak se\u00e7ilsin ister D2 olarak se\u00e7ilsin ana talepteki fark unsurun bulu\u015f basama\u011f\u0131 tesis etmedi\u011fini belirlemi\u015ftir. Di\u011fer yandan 1-5 aras\u0131 terditli taleplerin her birinde ana istemlere eklenen unsurlar da konu hakk\u0131nda uzman kimse i\u00e7in a\u015fikar kabul edilmi\u015ftir. S\u00f6zl\u00fc duru\u015fma s\u0131ras\u0131nda sunulan terditli talep 6 prosed\u00fcrel ekonomi ve talebin karma\u015f\u0131kl\u0131\u011f\u0131 dikkate al\u0131narak incelemeye kabul edilebilir olup olmad\u0131\u011f\u0131 bak\u0131m\u0131ndan incelenmi\u015f ve dosyaya kabul edilmemi\u015ftir.
