“A method of applying and\/or improving maintenance services to plants comprising,<\/p>\n

– providing a process description manual (10) in electronic form comprising a collection of operative business and maintenance processes,<\/p>\n

– providing a knowledge database (12) and providing hardware and software tools (14) for providing maintenance services to plants, wherein the process description manual (10), the knowledge database (12) and the hardware and software tools (14) are all interlinked to one another,<\/p>\n

– whereby the software tools (14) are installed in the plant (16) or are accessible over a network connection and are chosen utilizing shared information found in the process description manual (10) and the knowledge database (12).”<\/p><\/blockquote>\n

Ana istemde do\u011frudan at\u0131f konusu olan ve tarifname tak\u0131m\u0131nda belirtilen yaz\u0131l\u0131m ara\u00e7lar\u0131n\u0131n (software tools) hangi yaz\u0131l\u0131m ara\u00e7lar\u0131 oldu\u011fu ve nas\u0131l kullan\u0131ld\u0131\u011f\u0131 hakk\u0131nda hi\u00e7bir ayr\u0131nt\u0131 vermemekle birlikte ba\u015fvuru sahibi bunlar\u0131n ba\u015fvurunun dosyalanma tarihi itibariyle konu hakk\u0131nda uzman kimse i\u00e7in bilinen ve ortak genel bilgiye ait ara\u00e7lar oldu\u011fu konusunda da bir a\u00e7\u0131klama yapmam\u0131\u015ft\u0131r. Ek olarak bu yaz\u0131l\u0131m ara\u00e7lar\u0131n\u0131n pek \u00e7o\u011fu teknik olmayan i\u015flevlere sahiptir:\u00a0“management”, “decision support”, “strategy optimization”, “planning.”<\/i>\u00a0Aralar\u0131nda teknik bir unsurla veya i\u015flevle ili\u015fkilendirilebilecek olanlar\u0131n ise teknik i\u015flevleri tam olarak tan\u0131mlanmam\u0131\u015ft\u0131r:\u00a0“conditioned monitoring”, “digital control.”<\/i><\/p>\n

Temyiz sahibi \u0130nceleme Birimi\u2019nin ara\u015ft\u0131rma dahi yapmaks\u0131z\u0131n ancak ba\u015fvuruyu bulu\u015f basama\u011f\u0131 noksanl\u0131\u011f\u0131na dayand\u0131rarak reddetmesini asli bir prosed\u00fcr hatas\u0131 olarak nitelendirmektedir. Ayr\u0131ca ortada sunulan herhangi bir \u00f6nceki teknik yay\u0131n\u0131n\u0131n bulunmamas\u0131 da ba\u015fvuru sahibine g\u00f6re istemlerde d\u00fczeltme yap\u0131lmas\u0131n\u0131 imkans\u0131z k\u0131lm\u0131\u015ft\u0131r.<\/p>\n

Ana istemin teknik karaktere sahip olmamas\u0131 ve ortak genel bilginin par\u00e7as\u0131 oldu\u011fu fazlas\u0131yla malum olan unsurlara sahip olmas\u0131 halinde herhangi bir ara\u015ft\u0131rma yapmaks\u0131z\u0131n ve teknik karakter noksanl\u0131\u011f\u0131ndan \u00f6t\u00fcr\u00fc bulu\u015f basama\u011f\u0131n\u0131n mevcut olmad\u0131\u011f\u0131 gerek\u00e7esi ile ba\u015fvurular\u0131n reddedilmesinin yerle\u015fik i\u00e7tihad\u0131n bir par\u00e7as\u0131 oldu\u011fu ifade edilmektedir. Di\u011fer yandan Temyiz Kurulu hi\u00e7 ara\u015ft\u0131rma yap\u0131lmamas\u0131n\u0131 talihsizlik olarak de\u011ferlendirmekle birlikte bunu teknik karakterin hi\u00e7 bulunmad\u0131\u011f\u0131 bir durumda asli bir prosed\u00fcr hatas\u0131 olarak nitelemek i\u00e7in yeterli ko\u015ful olu\u015fmad\u0131\u011f\u0131n\u0131 de\u011ferlendirmektedir.<\/p>\n

Temyiz sahibinin ayr\u0131ca uluslararas\u0131 fazda ara\u015ft\u0131rma otoritesi olarak g\u00f6rev yapan EPO\u2019ya \u00f6dedi\u011fi ara\u015ft\u0131rma \u00fccretinin iadesine ili\u015fkin talebi ise Temyiz Kurulu taraf\u0131ndan yetkisizlik gerek\u00e7esi ile reddedilmi\u015ftir.<\/p>\n","protected":false},"excerpt":{"rendered":"
