Patent sahibi ana talebiyle birlikte iki yard\u0131mc\u0131 talep sunarak temyiz talebinde bulunmu\u015ftur.<\/p>\n

Temyiz Kurulu duru\u015fma davetiyle birlikte iletti\u011fi \u00f6n g\u00f6r\u00fc\u015f\u00fcnde \u201chigh-level database design\u201d yakla\u015f\u0131m\u0131n\u0131n teknik olup olmad\u0131\u011f\u0131 hakk\u0131ndaki ku\u015fkular\u0131n\u0131 ifade etmekle birlikte ana itiraz\u0131n\u0131 bulu\u015f basama\u011f\u0131 noksanl\u0131\u011f\u0131na dayand\u0131rm\u0131\u015ft\u0131r. Temyiz sahibi duru\u015fmaya kat\u0131l\u0131m sa\u011flamayaca\u011f\u0131n\u0131 ifade etmi\u015f ve duru\u015fma temyiz sahibi olmaks\u0131z\u0131n g\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Ana talepteki ilk istem a\u015fa\u011f\u0131da yer almaktad\u0131r:<\/p>\n

\u201cA computer method for managing and updating massive amounts of information relating to at least one event generating entity (106A-ZZ, 402) and contained in a networked computer system having:-<\/p>\n

a) an information supplier (102, 206, 306) having at least one memory device to store, in an information supplier universe database file UF (104, 310), a plurality of customer database files CF (120, 204, 304), each having a plurality of record entries (420);<\/p>\n

b) at least one information customer (108A-N,202,410a) computer having at least one memory device to store a customer data file CF (120a-n, 204);<\/p>\n

c) an Internet, wireless communication link, or other real-time communication link operable between the customer computer and the supplier computer;<\/p>\n

wherein the information supplier (102, 206, 306) computer is organised and arranged to:<\/p>\n

i) receive raw data corresponding to at least one event generating entity (106, 402);<\/p>\n

ii) process the raw data and generate at least one processed record entry (420);<\/p>\n

iii) associate each processed record entry with a unique universe identifier UUID (404);<\/p>\n

iv) store in at least one memory device a plurality of processed record entries (420) for the universe database file UF (104, 210, 310);<\/p>\n

characterised in that<\/b><\/u>\u00a0the information supplier (102, 206, 306) computer is further organised and arranged to:<\/p>\n

v) receive a transfer customer database file CF (120, 204, 304) from an information customer (108A-N,202, 410a) using storage devices or via any communication means, including wired or wireless communications such as satellite transmissions and the Internet;<\/p>\n

vi) store in at least one memory device a plurality of transferred customer database files CF (120a-n, 204, 304);<\/p>\n

vii) assign a unique customer identifier UCID (412) for each record entry contained in the transferred customer database files CF (120, 204, 304);<\/p>\n

viii) compare the content of the transferred customer database files CF (120, 204, 304) with the content of the universe database file UF (104, 210, 310);<\/p>\n

ix) generate a conversion table CT (218, 318, 440) providing a mapping between the unique customer identifiers UCID’s (412) and a corresponding set of unique universal identifiers UIID’s (404) contained in the universe database file UF (104, 210, 310);<\/p>\n

x) update a portion of at least one record entry in a transferred customer database file CF (212) with information contained in the processed record entry associated with the unique universe identifier UUID (404) corresponding to the unique customer identifier UCID (412) associated with the at least one record entry; and,<\/p>\n

xi) deliver an updated transfer customer database file to the information customer via communication means.\u201d<\/p><\/blockquote>\n

M\u00fc\u015fteriler ise bilgiyi ayn\u0131 mant\u0131kla “customer database files<\/i>” (CF) dosyalar\u0131nda tutmakta olup burada her kay\u0131t “unique customer identifier<\/i>” (UCID) \u015feklinde endeskli haldedir.<\/p>\n

Ana istemin en yak\u0131n \u00f6nceki teknik belgesi kar\u015f\u0131s\u0131ndaki fark unsuru bilgiyi sat\u0131n alan taraf\u0131n bilgi sa\u011flay\u0131c\u0131s\u0131na bir veritaban\u0131 dosyas\u0131 iletmesi ve veritaban\u0131 i\u00e7indeki her kayda \u00f6zel bir tan\u0131mlay\u0131c\u0131 atamas\u0131d\u0131r. Bilgi sa\u011flay\u0131c\u0131 da UCID ve UUID tan\u0131mlay\u0131c\u0131lar\u0131 aras\u0131nda uygun bir d\u00f6n\u00fc\u015ft\u00fcrme tablosu yaratmaktad\u0131r.<\/p>\n

\u0130nceleme Birimi\u2019nin karar\u0131na g\u00f6re bilgi sat\u0131n alan taraf\u0131n bir veritaban\u0131 dosyas\u0131n\u0131 sat\u0131c\u0131ya g\u00f6ndermesi ve buradaki kay\u0131tlar\u0131n endekslenmesi teknik olmayan ve i\u015f yapma y\u00f6ntemlerine ili\u015fkin olan uygulamalard\u0131r. Patent sahibi fark unsurlar\u0131n veritaban\u0131n\u0131n \u00fc\u00e7\u00fcnc\u00fc taraflarca eri\u015fime kar\u015f\u0131 daha g\u00fcvenli k\u0131l\u0131nmas\u0131 gibi bir teknik sonu\u00e7 \u00fcretti\u011fini iddia etmektedir.<\/p>\n

T 641\/00 (Comvik) karar\u0131na g\u00f6re bir istem i\u00e7erisinde yer alan ve teknik nitelikte olmayan unsurlar konu hakk\u0131nda uzman kimseye bir problemin par\u00e7as\u0131 olarak sunuluyor iseler teknik \u00e7\u00f6z\u00fcm\u00fcn bir par\u00e7as\u0131 olmazlar ve b\u00f6ylelikle bulu\u015f basama\u011f\u0131n\u0131 tesis etmekte kullan\u0131lamazlar. B\u00f6ylelikle istemin i\u00e7inde hangi unsurun teknik oldu\u011fu ve hangi unsurun teknik olmad\u0131\u011f\u0131 aras\u0131ndaki ayr\u0131m \u00f6nem kazanmaktad\u0131r.<\/p>\n

T 1463\/11 (Cardinal Commerce) karar\u0131na g\u00f6re istemde yer alan hangi unsurlar\u0131n teknik oldu\u011fu ve hangilerinin olmad\u0131\u011f\u0131 konusu teknik olmayan bir uzman g\u00f6z\u00fcyle de de\u011ferlendirilebilir. Buna g\u00f6re Temyiz Heyeti veri g\u00fcvenli\u011fi arg\u00fcman\u0131 kar\u015f\u0131s\u0131nda i\u015f odakl\u0131 bir insan\u0131n da verinin kontrol\u00fcn\u00fc elde tutma amac\u0131yla teknik olmayan ama benzer nitelikte bir endeksleme \u00e7al\u0131\u015fmas\u0131na r\u0131za g\u00f6sterece\u011fini de\u011ferlendirmektedir. Dolay\u0131s\u0131yla istem D6 kar\u015f\u0131s\u0131nda teknik olmayan bir fark unsura sahip oldu\u011fundan bulu\u015f basama\u011f\u0131 yoktur. Bir i\u015f insan\u0131 i\u00e7in veri g\u00fcvenli\u011fi mevcut \u00f6rnekte teknik nedenlerden de\u011fil ticari nedenlerden ileri gelen bir gereklilik olarak \u00f6ne \u00e7\u0131kmaktad\u0131r.<\/p>\n

Ayn\u0131 \u015fekilde veritaban\u0131ndaki her kayda \u00f6zel bir tan\u0131mlay\u0131c\u0131 ataman\u0131n da teknik bir unsur olup olmad\u0131\u011f\u0131 konusunda ku\u015fkular mevcuttur. \u00d6rne\u011fin bu unsur i\u00e7in de bir i\u015f insan\u0131 \u201cHer m\u00fc\u015fteriyi \u00f6zel olarak tan\u0131mlayabilmemiz gerekir\u201d, \u015feklinde bir gereklilik ortaya atabilir. Bu gereklili\u011fin teknik nedenlerden de\u011fil ticari nedenlerden ortaya \u00e7\u0131kt\u0131\u011f\u0131 a\u015fikard\u0131r.
