Temyiz talebi ilk temyiz dosyas\u0131nda (T 2368\/10) t\u00fcm dok\u00fcmanlar\u0131n yanl\u0131\u015f vekile g\u00f6nderilmesi gerek\u00e7esine dayanmaktad\u0131r.<\/p>\n<p>\u0130tiraz prosed\u00fcr\u00fc s\u0131ras\u0131nda as\u0131l vekil s\u00f6zl\u00fc duru\u015fmaya kat\u0131lmak \u00fczere ikinci bir vekil tayin etmi\u015ftir. \u0130lk temyiz prosed\u00fcr\u00fc t\u00fcm temyiz ba\u015fvurular\u0131 geri \u00e7ekildi\u011finden karar al\u0131nmaks\u0131z\u0131n sonlanm\u0131\u015ft\u0131r. Bu nedenle patente dair s\u00fcre\u00e7 \u0130tiraz Birimi taraf\u0131ndan d\u00fczeltilmi\u015f olarak muhafaza edildi\u011fi formuyla tescil \u00fccretinin \u00f6denmesine ve istem \u00e7evirilerinin yap\u0131lmas\u0131na davette bulunan EPC\u00a0<a href=\"https:\/\/www.epo.org\/law-practice\/legal-texts\/html\/epc\/2016\/e\/r82.html\">Kural 82(2)<\/a>\u00a0yaz\u0131s\u0131yla s\u00fcrm\u00fc\u015ft\u00fcr. \u0130lgili \u00fccret \u00f6demesi ve istem \u00e7evirileri normal ve Kural 83(3) alt\u0131ndaki cezal\u0131 s\u00fcrede de \u00f6denmeyince patent 6 \u015eubat 2017 tarihli karar ile ge\u00e7ersiz hale gelmi\u015ftir.<\/p>\n<p>Yaln\u0131z bu a\u015famada enteresan bir nokta olarak itiraz sahiplerinden birisi tescil \u00fccretini \u00f6demi\u015ftir.<\/p>\n<p>Temyiz sahipleri as\u0131l vekilin dosyan\u0131n ge\u00e7ersiz hale gelmesinden ancak 30 Ekim 2017 tarihli y\u0131ll\u0131k \u00fccret \u00f6demesi a\u015famas\u0131nda haberdar oldu\u011funu ve 20 Ekim tarihinde mevcut temyiz talebiyle birlikte tescil \u00fccretinin yat\u0131r\u0131larak, di\u011fer iki EPO resmi dilindeki istem \u00e7evirilerinin dosyaland\u0131\u011f\u0131n\u0131 belirtmektedirler. Patent sahibi bulunan temyiz sahiplerine g\u00f6re ge\u00e7ersizlik karar\u0131 h\u00fck\u00fcms\u00fczd\u00fcr.<\/p>\n<p>Mevcut Temyiz Kurulu karar\u0131nda 6 \u015eubat 2017 tarihli ge\u00e7ersizlik karar\u0131ndan itibaren temyiz ba\u015fvurusu yapmak i\u00e7in son tarihin 18 Nisan 2017 oldu\u011funu (16 Nisan resmi tatil) ve temyiz gerek\u00e7elerine dair dilek\u00e7eyi sunmak i\u00e7in 4 ayl\u0131k son tarihin ise en ge\u00e7 16 Haziran 2017 oldu\u011funu belirtmektedir.<\/p>\n<p>Temyiz Kurulu temyiz sahiplerinin EPC Md. 122(1) alt\u0131nda haklar\u0131n yeniden tesisi i\u00e7in talep yapabilecekken bunun yerine temyiz talebi yapt\u0131klar\u0131n\u0131 not etmektedir.
