EP 2 346 911<\/a>\u00a0patenti itiraz s\u0131ras\u0131nda 8. terditli talebe dayal\u0131 olarak muhafaza edilmi\u015ftir. Temyiz edilen karar temel olarak 1-7 aras\u0131 taleplere dayal\u0131d\u0131r. Ana talebe ait ana istem a\u015fa\u011f\u0131da verilmi\u015ftir:<\/p>\n

“1. Proc\u00e9d\u00e9 de fabrication d’un copolym\u00e8re de l’\u00e9thyl\u00e8ne et d’au moins un ester vinylique d’acide carboxylique comprenant les \u00e9tapes suivantes :<\/p>\n

a) fermentation de mati\u00e8res premi\u00e8res renouvelables et, \u00e9ventuellement purification pour produire au moins un alcool choisi parmi l’\u00e9thanol et les m\u00e9langes d’alcools comprenant de l’\u00e9thanol ;<\/p>\n

b) d\u00e9shydratation de l’alcool obtenu pour produire au moins un alc\u00e8ne choisi parmi l’\u00e9thyl\u00e8ne et les m\u00e9langes d’alc\u00e8nes comprenant de l’\u00e9thyl\u00e8ne et, \u00e9ventuellement purification de l’alc\u00e8ne pour obtenir de l’\u00e9thyl\u00e8ne,<\/p>\n

c) copolym\u00e9risation de l’\u00e9thyl\u00e8ne avec au moins un comonom\u00e8re choisi parmi les esters vinyliques d’acides carboxyliques,<\/p>\n

d) isolation du copolym\u00e8re obtenu.”<\/p><\/blockquote>\n

Bulu\u015f basama\u011f\u0131 eksikli\u011fi gerek\u00e7esi olarak D2 en yak\u0131n \u00f6nceki yay\u0131n\u0131 olmak \u00fczere etilen ve vinil asetat kopolimerlerine ait \u00fcretim prosesinin konu hakk\u0131nda uzman kimse i\u00e7in ortak genel bilgisi veya D14 tabanl\u0131 olarak bilinir oldu\u011fu belirtilmektedir. Alternatif olarak D29-D2 kombinasyonu da bulu\u015f basama\u011f\u0131n\u0131 kald\u0131r\u0131c\u0131 nitelikte g\u00f6r\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n

Temyiz sahibi temyiz dilek\u00e7esinde D2\u2019nin en yak\u0131n \u00f6nceki teknik yay\u0131n\u0131 olarak g\u00f6r\u00fclemeyece\u011fini ve onun yerine D29\u2019un en yak\u0131n \u00f6nceki teknik olarak al\u0131nmas\u0131 halinde ona dayal\u0131 teknik problemin etilen kopolimerleri \u00fcretmek i\u00e7in alternatif bir metoda indirgenmesi gerekti\u011fini belirtmektedir. Bu durumda konu hakk\u0131nda uzman kimsenin hi\u00e7bir \u015fekilde D2 \u00f6\u011fretisini uygulamak \u00fczere te\u015fvik edilmemi\u015f olaca\u011f\u0131 dikkate al\u0131n\u0131rsa bulu\u015f basama\u011f\u0131n\u0131n teslim edilmesi gerekti\u011fi ifade edilmektedir. Temyiz Kurulu D2\u2019nin en yak\u0131n belge olarak kabul\u00fc konusunda g\u00f6r\u00fc\u015fe varm\u0131\u015ft\u0131r.<\/p>\n

Temyiz sahibinin 3 ve 4. terditli taleplerine ait ana istemlerinin ek olarak geleneksel filtreler \u00fczerinde uygulanan bir ar\u0131tma ad\u0131m\u0131 ve elde edilen kopolimerler i\u00e7in bir izolasyon ad\u0131m\u0131 tan\u0131mlad\u0131\u011f\u0131 g\u00f6r\u00fclmektedir. En yak\u0131n teknik olarak g\u00f6r\u00fclen D2 \u015feker kam\u0131\u015f\u0131n\u0131n fermantasyonuyla elde edilen etanol\u00fcn dehidrasyonu ile elde edilen etilenin ar\u0131nd\u0131r\u0131ld\u0131\u011f\u0131n\u0131 a\u00e7\u0131klamaktad\u0131r. Etilenin kurutulma bi\u00e7imi a\u00e7\u0131klanmamakla birlikte etanol\u00fcn dehidrasyonuyla etilen elde etme y\u00f6nteminin gayet iyi bilinen bir y\u00f6ntem oldu\u011fu a\u00e7\u0131klanmaktad\u0131r. Temyiz sahibinin konu hakk\u0131nda uzman kimsenin istem konusu kurutma ad\u0131m\u0131n\u0131 tasarlayamayaca\u011f\u0131na dair g\u00f6r\u00fc\u015f\u00fc kabul edilmemi\u015ftir. Burada T 939\/92 karar\u0131na at\u0131f yap\u0131larak konu hakk\u0131nda uzman kimsenin neyi uygulay\u0131p neyi uygulamayaca\u011f\u0131 sorusunun cevab\u0131n\u0131n neyi elde etmeyi arzu edece\u011fine ba\u011fl\u0131 olarak belirlendi\u011fi belirtilmi\u015ftir.
