Temyiz \u0130tiraz Birimi\u2019nin 2. terditli talebe dayal\u0131 olarak patenti de\u011fi\u015ftirilmi\u015f halde muhafaza etme karar\u0131na kar\u015f\u0131l\u0131k olarak itiraz sahibi taraf\u0131ndan dosyalanm\u0131\u015ft\u0131r (EP 2 106 282<\/a>).\u00a0Temyiz konusu ana istem a\u015fa\u011f\u0131da verilmi\u015ftir:<\/p>\n

“1. A filter element (100) defining a longitudinal axis (102) and first and second axial ends (104,106) of the filter element, the filter element comprising:<\/p>\n

a winding structure (108), and a length of fluted filter media (110), having first and second axial ends, wound about the winding structure (108) with the flutes of the media (110) oriented substantially parallel to the longitudinal axis, to thereby provide for filtration of a flow of fluid passing substantially parallel to the longitudinal axis through the filter element (100);<\/p>\n

the winding structure (108) defining a winding structure axis (128) extending substantially parallel to the longitudinal axis (102) of the filter element, and oppositely facing axial ends (130,132) of the winding structure disposed at opposite ends of the winding structure (108) along the winding structure axis (128) adjacent and axially inward from the corresponding first and second axial ends of the fluted filter media (110);<\/p>\n

the winding structure (108) having a length, width and thickness thereof, with the length extending substantially along the winding structure axis (128) between the first and second axial ends (130,132) of the winding structure, the width extending substantially orthogonally to the winding structure axis (128), and the thickness extending substantially orthogonally to both the winding structure axis (128) and the width of the winding structure (108);\u00a0characterized in that<\/b><\/u><\/p>\n

the winding structure (108) also includes a winding feature (112) extending substantially axially outward from and beyond at least one of the axial ends of the winding structure (108);<\/p>\n

the winding feature (112) is configured for receiving a winding torque, applied to the winding structure (108), for rotation of the winding structure (108) about a winding axis (128) extending substantially parallel to the longitudinal axis (102) of the filter element (100), as the media (110) is wound onto the winding structure (108); and<\/p>\n

the axial end of the filter element (100), which is formed by one of the lateral edges of the fluted filter media wound about the winding structure (102), being disposed substantially flush with the distal end (176) of the winding feature (112).”<\/p><\/blockquote>\n

\u0130tiraz Birimi \u00f6n\u00fcnde g\u00f6r\u00fclen incelemede patent sahibinin \u201caxial ends\u201d ibaresini \u00e7o\u011fuldan tekil yap\u0131ya \u201caxial end\u201d \u015feklinde d\u00f6n\u00fc\u015ft\u00fcrmesi Md. 123(2) alt\u0131nda bir itiraz konusu olarak g\u00f6r\u00fclmemi\u015f ve bir yaz\u0131m hatas\u0131 olarak kabul edilmi\u015ftir. \u0130tirazda bulunan temyiz sahibi ise bu de\u011fi\u015fikli\u011fin kapsam a\u015f\u0131m\u0131 ihlaline yol a\u00e7t\u0131\u011f\u0131 g\u00f6r\u00fc\u015f\u00fcndedir.<\/p>\n

Temyiz Kurulu\u2019nun g\u00f6r\u00fc\u015f\u00fcne g\u00f6re \u0130stem l’e g\u00f6re, karakterize edici k\u0131sm\u0131n birinci paragraf\u0131, “eksenel u\u00e7lar\u0131n\u0131n en az birinin” ifadesine sahiptir. Bu nedenle, istemin, sarma unsurunun her iki eksenel ucu ile ilgili bir yoruma m\u00fcsaade etti\u011fini \u00f6ng\u00f6rmek makul de\u011fildir. Ayn\u0131 \u015fekilde \u0130stem 2\u2019nin de yorumu tek bir eksensel u\u00e7 yorumunu daha g\u00fc\u00e7l\u00fc k\u0131lmaktad\u0131r. Son olarak EPC Md. 69\u2019dan hareketle tarifname \u00fczerinden istem yorumuna ba\u015fvuruldu\u011funda da sonu\u00e7 de\u011fi\u015fmemektedir. B\u00f6ylece kapsam a\u015f\u0131m\u0131 ihlali tart\u0131\u015fmas\u0131 patent sahibi lehine sonu\u00e7lanm\u0131\u015ft\u0131r.<\/p>\n

Ara genelleme tart\u0131\u015fmas\u0131na ili\u015fkin olarak ise istemden “to a distal end of the winding feature” ifadesinin silinmesinin orijinal olarak desteklenmeyen bir unsur grubunu istemde b\u0131rakt\u0131\u011f\u0131 g\u00f6r\u00fc\u015f\u00fc yine kabul edilmemi\u015ftir. \u0130tiraz sahibi temyiz sahibinin bu silinmeye ili\u015fkin tarifname deste\u011finin tarifnamede \u00fcr\u00fcne ait unsurlar\u0131n anlat\u0131ld\u0131\u011f\u0131 de\u011fil metoda ait unsurlar\u0131n anlat\u0131ld\u0131\u011f\u0131 pasajlarda yer ald\u0131\u011f\u0131na ili\u015fkin g\u00f6r\u00fc\u015f\u00fc de yine kabul g\u00f6rmemi\u015ftir.<\/p>\n
