\u201c1. A method of processing non-fetal donor liver tissue to obtain an enriched population of liver progenitor cells comprising:<\/p>\n

(a) providing non-fetal donor tissue obtained from a donor whose heartbeat has ceased, within 30 hours postmortem but not during the period within three hours after the heartbeat ceased; and<\/p>\n

(b) processing said non-fetal donor tissue to obtain an enriched population of liver progenitor cells”.<\/p><\/blockquote>\n

Temyiz konusu dosyada \u0130tiraz Birimi \u00f6n\u00fcnde g\u00f6r\u00fclen duru\u015fma s\u0131ras\u0131nda itiraz sahibi EPC Md. 83 alt\u0131nda tamamen yeni bir gerek\u00e7e ortaya koymu\u015f ve patent sahibi ve bulu\u015f sahipleri ABD\u2019de ba\u015fka bir zaman diliminde oldu\u011fundan g\u00f6r\u00fc\u015flerine ba\u015fvurulmaks\u0131z\u0131n Md. 83 kusurlar\u0131 alt\u0131nda patent iptal edilmi\u015ftir. Buradaki Md. 83 itirazlar\u0131 istemde belirtillen don\u00f6rlerin ya\u015f\u0131 konusunda tarifnamede yeterince bilgilendirme yap\u0131lmamas\u0131na dayanmaktad\u0131r. Daha \u00f6nce sunulmalar\u0131 m\u00fcmk\u00fcn olmayan 1-5 aras\u0131 yard\u0131mc\u0131 talepler temyiz prosed\u00fcr\u00fcnde incelenmek \u00fczere kabul edilmi\u015ftir.<\/p>\n

\u0130tiraz sahibinin (temyiz sahibi) g\u00f6r\u00fc\u015flerine g\u00f6re patent sahibinin ilk defa itiraz duru\u015fmas\u0131nda ortaya \u00e7\u0131kan Md. 83 gerek\u00e7eleri kar\u015f\u0131s\u0131nda s\u00fcrpriz bir durumla kar\u015f\u0131la\u015farak haz\u0131rl\u0131ks\u0131z yakalanmas\u0131 s\u00f6z konusu de\u011fildir; zira bu konudaki kan\u0131tlar do\u011frudan patent sahibinin kendi tarifnamesine dayanmaktad\u0131r. Ayr\u0131ca itiraz duru\u015fmas\u0131 s\u0131ras\u0131nda patent sahibi ne erteleme talep etmi\u015ftir ne de bu konuyu ele alan ek taleplerde bulunmu\u015ftur. Temyiz Kurulu bu konuda cevap hakk\u0131n\u0131n ihlali nedeniyle bir prosed\u00fcr hatas\u0131 yap\u0131ld\u0131\u011f\u0131 g\u00f6r\u00fc\u015f\u00fcn\u00fc payla\u015fmam\u0131\u015ft\u0131r; zira patent sahibi bu gerek\u00e7enin kabul\u00fcne kar\u015f\u0131 \u00e7\u0131kmam\u0131\u015f veya konuyu bulu\u015f sahipleriyle tart\u0131\u015fma ihtiyac\u0131 nedeniyle erteleme talep etmemi\u015ftir.<\/p>\n

Ana talebe ili\u015fkin kapsam a\u015f\u0131m\u0131 itirazlar\u0131 konusunda “providing non-fetal donor tissue obtained from a donor whose heartbeat has ceased, within 30 hours postmortem but not during the period within three hours after the heartbeat ceased<\/i>” ad\u0131m\u0131nda Md. 123(2) ihlali oldu\u011fu g\u00f6r\u00fc\u015f\u00fc hakim olmu\u015ftur. Bu unsura g\u00f6re don\u00f6r\u00fcn kalbinin doku al\u0131nmadan en az \u00fc\u00e7 saat \u00f6nce durmu\u015f olmas\u0131 gerekmektedir. Kurul istemde yer alan negatif tan\u0131mlamaya (disclaimer) ili\u015fkin deste\u011fi a\u015fa\u011f\u0131daki tarifname pasaj\u0131nda bulmaktad\u0131r:<\/p>\n
