Kurulun g\u00f6r\u00fc\u015f\u00fcne g\u00f6re \u0130stem 11 de EPC\u00a0<a href=\"https:\/\/www.epo.org\/law-practice\/legal-texts\/html\/epc\/2016\/e\/ar53.html\">Md. 53(c)<\/a>\u2019yi ihlal etmektedir.<\/p>\n<p>Temyiz sahibi 14.01.2019 tarihli dilek\u00e7esiyle duru\u015fmaya kat\u0131lmayaca\u011f\u0131n\u0131 ve dosyan\u0131n mevcut durumuna dayal\u0131 bir karar talep etti\u011fini bildirmi\u015ftir. Temyiz sahibinin kat\u0131lmama bildirimi duru\u015fma talebinin geri \u00e7ekilmesi olarak kabul edilerek yaz\u0131l\u0131 karar \u00e7\u0131kar\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>Bu karar uyar\u0131nca \u0130stem 11 EPC Md. 53(c) h\u00fck\u00fcmlerine ayk\u0131r\u0131 bi\u00e7imde tedavi etkisi olan bir y\u00f6ntemi korumaya \u00e7al\u0131\u015fmaktad\u0131r. Te\u015fhis ve tedavi usulleri patent korumas\u0131ndan istifade edemediklerinden ana talep reddedilmi\u015ftir. \u0130stem 11 t\u00fcm yard\u0131mc\u0131 taleplerde de\u011fi\u015fmeden muhafaza edildi\u011finden ayn\u0131 durum t\u00fcm talepler a\u00e7\u0131s\u0131ndan ge\u00e7erlidir.
