Temyiz sahibi dilek\u00e7esinde yaz\u0131l\u0131 kararda \u0130nceleme Birimi\u2019nin daha \u00f6nce iletti\u011fi yaz\u0131\u015fmalardaki a\u00e7\u0131klamalar\u0131n\u0131 al\u0131nt\u0131lanm\u0131\u015f halde yeniden d\u00fczenleyerek iletti\u011fini ve ba\u015fvuru sahibinin arg\u00fcmanlar\u0131n\u0131n \u0130nceleme Birimi taraf\u0131ndan ger\u00e7ekten dikkate al\u0131n\u0131p al\u0131nmad\u0131\u011f\u0131n\u0131n anla\u015f\u0131lmad\u0131\u011f\u0131n\u0131 ifade etmektedir. Ayr\u0131ca yaz\u0131l\u0131 karar\u0131n duru\u015fmada g\u00fcndem konusu olan hususlarla k\u0131smen ilgili oldu\u011fu ileri s\u00fcr\u00fclmektedir. Temyiz Kurulu yukar\u0131daki arg\u00fcmanlar kar\u015f\u0131s\u0131nda duru\u015fma davetiyle birlikte iletti\u011fi \u00f6n g\u00f6r\u00fc\u015f\u00fcnde ba\u015fvuru sahibinin\u00a0EPC Md. 113<\/a>\u00a0kapsam\u0131nda savunma hakk\u0131n\u0131n \u00e7i\u011fnendi\u011fini ve \u0130nceleme Birimi\u2019nin yaz\u0131l\u0131 karar\u0131n\u0131n\u00a0Kural 111(1)<\/a>\u2019i ihlal edecek bi\u00e7imde yeterince gerek\u00e7elendirilmedi\u011fini ifade etmektedir.<\/p>\n

Duru\u015fma ba\u015flang\u0131c\u0131 s\u0131ras\u0131nda Temyiz Kurulu \u00f6n\u00fcnde olan en y\u00fcksek \u00f6ncelikli talebe ait ana istem a\u015fa\u011f\u0131da verilmektedir:<\/p>\n

“An information processing apparatus (101) for transmitting content data (S15) in response to a content transmission request from a client, characterized by comprising:<\/p>\n

a data transmitting and receiving unit (501) for executing data transmission and reception processing with the client via a network;<\/p>\n

a content storage unit (503) for storing content;<\/p>\n

a control unit (201) for managing content stored in the content storage unit;<\/p>\n

a metadata storage unit (504) for storing metadata;<\/p>\n

a property information acquisition unit (505) for extracting property information, said property information being a component of the metadata, from the metadata storage unit; and<\/p>\n

a transmission data generation unit (506) for generating data to be transmitted to the client, based on the property information acquired by the property information acquisition unit;<\/p>\n

wherein each item of content is defined as an object, and a folder storing a plurality of contents is defined as an object;<\/p>\n

a class is defined as information indicating category classification of the object, a plurality of the classes having a hierarchical structure;<\/p>\n

the class is set to indicate the category classification to each of the objects; and<\/p>\n

a plurality of objects is managed by using a content directory having a hierarchical structure,<\/p>\n

the metadata storage unit being configured to store, with respect to each of the objects: a plurality of property information including identification information of the object; class information indicating the category classification of the object; and information relating to the hierarchical structure of the content directory,<\/p>\n

the property information acquisition unit being configured to extract the property information of an object included in a designated class in response to a property information acquisition request with class designation from the client received by the data transmitting and receiving unit;<\/p>\n

the transmission data generation unit being configured to generate transmission data including: the property information extracted by the property information acquisition unit; and information of an allowable value settable as data of the extracted property information, and<\/p>\n

the data transmitting and receiving unit being configured to transmit the transmission data generated by the transmission data generation unit to the client.”<\/p><\/blockquote>\n

\nMevcut bulu\u015f, metadata g\u00fcncelleme i\u015flemlerine ili\u015fkin olup metadatan\u0131n bir i\u00e7erik sunucusundan bir istemciye aktar\u0131lmas\u0131 ile ilgilidir. Temyiz Kurulu ana istemin D4 dok\u00fcman\u0131 kar\u015f\u0131s\u0131nda a\u015fa\u011f\u0131daki unsur bak\u0131m\u0131ndan yeni oldu\u011funu tespit etmektedir:<\/p>\n

(i) “information of an allowable value settable as data of the extracted property information”.<\/p><\/blockquote>\n

Temyiz sahibi duru\u015fma s\u0131ras\u0131nda kurulun bu tespitine kar\u015f\u0131 arg\u00fcman \u00fcretmemi\u015ftir ancak EPC\u2019nin tarifname tak\u0131m\u0131nda t\u00fcm teknik problem tan\u0131mlar\u0131n\u0131n bulunmas\u0131n\u0131 zorunlu k\u0131ld\u0131\u011f\u0131na dair bir durum bulunmad\u0131\u011f\u0131n\u0131 ifade etmi\u015ftir.<\/p>\n

Temyiz sahibi yukar\u0131daki fark unsurun D4 kar\u015f\u0131s\u0131nda sunucuya g\u00f6nderilen taleplerin say\u0131s\u0131n\u0131 azaltma teknik etkisini olu\u015fturdu\u011funu ifade etmektedir.<\/p>\n

Temyiz Kurulu \u00fcstteki fark unsurda yer alan atanan de\u011fer bilgisinin nas\u0131l kullan\u0131ld\u0131\u011f\u0131 konusunda istemde ba\u015fkaca a\u00e7\u0131klama olmad\u0131\u011f\u0131ndan bir teknik etkiye sahip olabilece\u011fi konusunda ku\u015fku duymakla birlikte istemin tarifname ile birlikte\u00a0de\u011ferlendirilmesi halinde temyiz sahibinin arg\u00fcman\u0131na kat\u0131lmaktad\u0131r.<\/p>\n

Di\u011fer yandan Temyiz Kurulu, istemin temyiz sahibinin \u00f6nerdi\u011fi bi\u00e7imde yorumlanmas\u0131 halinde bile konu hakk\u0131nda uzman kimse i\u00e7in ba\u015fvurunun yap\u0131ld\u0131\u011f\u0131 tarih itibariyle\u00a0istemci-sunucu sistemlerinde veri do\u011frulamas\u0131n\u0131n istemcide, sunucuda veya hem istemcide hem de sunucuda yap\u0131labilir oldu\u011funun<\/u>\u00a0D1\u2019den hareketle ortak genel bilgi kapsam\u0131nda biliniyor oldu\u011fu ger\u00e7e\u011finden hareketle bulu\u015f basama\u011f\u0131ndan yoksun oldu\u011funa karar vermi\u015ftir.<\/p>\n

Ana talep harici birinci ve ikinci yard\u0131mc\u0131\/terditli talepler de benzer gerek\u00e7eler ile bulu\u015f basama\u011f\u0131ndan yoksun bulunmu\u015f olmakla birlikte \u00fc\u00e7\u00fcnc\u00fc terditli talebe ait istem seti i\u00e7in Temyiz Kurulu a\u015fa\u011f\u0131daki g\u00f6r\u00fc\u015fe varm\u0131\u015ft\u0131r. Bu talebe ait istem seti \u0130nceleme Birimi\u2019nin karar\u0131n\u0131n do\u011frudan bir par\u00e7as\u0131 de\u011fildir ancak ana istem ara\u015ft\u0131rmas\u0131 \u0130nceleme Birimi taraf\u0131ndan yap\u0131lm\u0131\u015f bulunan \u0130stem 4 ile uyumlu bir i\u00e7eri\u011fe sahiptir. Bu nedenle \u00fc\u00e7\u00fcnc\u00fc talebe ait istem setinin temyiz incelemesine kabul\u00fc m\u00fcmk\u00fcn g\u00f6r\u00fcnm\u00fc\u015ft\u00fcr; ancak s\u00f6z konusu istemler \u0130nceleme Birimi taraf\u0131ndan hi\u00e7 ele al\u0131nmad\u0131\u011f\u0131ndan ve yeni bir inceleme gerekli olaca\u011f\u0131ndan dosyan\u0131n \u0130nceleme Birimi taraf\u0131ndan yeniden g\u00f6r\u00fclmesi gerek\u00e7esiyle birinci derece merciine iadesine karar verilmi\u015ftir.<\/p>\n","protected":false},"excerpt":{"rendered":"
