Patent sahibi bu de\u011ferleri \u00f6zellikle aral\u0131ktaki t\u00fcm olas\u0131 de\u011ferlerden se\u00e7mek i\u00e7in \u00f6zel bir neden olmayaca\u011f\u0131ndan, \u0130stem 1&#8217;in D2 dok\u00fcman\u0131 kar\u015f\u0131s\u0131nda a\u015fikar olarak kabul edilemeyece\u011fini belirtmektedir. Temyiz Kurulu bu arg\u00fcman\u0131 inand\u0131r\u0131c\u0131 bulmamakla birlikte ikinci terditli talebe ait ana istemin bulu\u015f basama\u011f\u0131 gere\u011fini kar\u015f\u0131lad\u0131\u011f\u0131n\u0131 de\u011ferlendirmektedir. \u0130kinci terditli talep, ana isteme ait fark unsurda yer alan Form\u00fcl I konusu 3-20 aras\u0131 &#8220;k&#8221;, 100-2000 aras\u0131 &#8220;m&#8221; indisine sahip aminosilikonlar \u00f6zelli\u011fine ek olarak amino grubunun monoamin oldu\u011funu tan\u0131mlamaktad\u0131r.
