Temyiz s\u0131ras\u0131nda ana talebe ili\u015fik ana istem a\u015fa\u011f\u0131da verilmektedir:<\/p>\n<blockquote><p>&#8220;A chamber with shape memory for the pressure correction in a tire, which is a part of the tire or adjacent to the tire wall and is connected with the interior of the tire on one end and with the external environment on the other end, the chamber (1) being in the shape of a curved hollow channel and being placed in the area of the tire side wall (4) at its bead, characterised in that it has at least one its enclosing wall formed at least by a part of a pair of surfaces (10) lengthwise coplanar with the chamber (1) and making an angle alpha = 0 to 120\u00b0, where if the angle alpha &gt; 0\u00b0, it is at the connecting edge of these surfaces (10), located on the further side from the center of the surface of the chamber (1) cross-section, the chamber has a width of 0.1 mm to 200 mm and thickness of 0.01 to 100 mm.&#8221;<\/p><\/blockquote>\n<p>Tescil edilen isteme g\u00f6re itiraz s\u00fcrecinde d\u00fczeltilen istem ek olarak a\u015fa\u011f\u0131daki unsur grubunu i\u00e7ermektedir:<\/p>\n<blockquote><p>(i) the chamber has a width of 0.1 mm to 200 mm and thickness of 0.01 to 100 mm.<\/p><\/blockquote>\n<p>\u0130tiraz Birimi\u2019nin g\u00f6r\u00fc\u015f\u00fcne g\u00f6re bu unsur grubu patent ba\u015fvurusunun orijinal tarifnamesi taraf\u0131ndan desteklenmekte, yani konu hakk\u0131nda uzman kimse taraf\u0131ndan ilk ba\u015fvuru metni i\u00e7erisinde tart\u0131\u015fmaya yer b\u0131rakmayacak bi\u00e7imde a\u00e7\u0131k olarak anla\u015f\u0131labilmektedir.<br \/>\nKapsam a\u015f\u0131m\u0131 incelemesi EPO taraf\u0131ndan\u00a0<a href=\"https:\/\/www.epo.org\/law-practice\/case-law-appeals\/recent\/g100002ex1.html\">G2\/10<\/a>\u00a0karar\u0131nda a\u00e7\u0131kland\u0131\u011f\u0131 \u00fczere \u201cGold Standard\u201d alt\u0131nda yani m\u00fcmk\u00fcn olan en keskin denetleme kar\u015f\u0131s\u0131nda m\u00fcspet sonu\u00e7 verecek \u015fekilde yap\u0131lmaktad\u0131r.<\/p>\n<p>Temyiz Kurulu\u2019nun de\u011ferlendirmesine g\u00f6re bir ta\u015f\u0131t lasti\u011finde bas\u0131n\u00e7 ayarlamas\u0131 yap\u0131lan odac\u0131\u011f\u0131n istem konusu yap\u0131lan boyutlar\u0131, orijinal olarak ba\u015fvuruda bulunulan metin kapsam\u0131nda, hi\u00e7bir \u015fekilde a\u00e7\u0131k veya \u00fcst\u00fc kapal\u0131 bi\u00e7imde olsa bile meslek erbab\u0131 taraf\u0131ndan \u00e7\u0131karsanabilecek bi\u00e7imde if\u015fa\u00a0<u>edilmemektedir<\/u>. Uygulama boyunca a\u00e7\u0131klanan spesifik boyutlar, sadece lasti\u011fin imalat i\u015flemi s\u0131ras\u0131nda ve vulkanizasyondan \u00f6nce oday\u0131 olu\u015fturmak i\u00e7in kullan\u0131lan matrise kar\u015f\u0131l\u0131k gelmektedir; ancak daha sonra vulkanizasyon ger\u00e7ekle\u015fti\u011finde ve matris olu\u015fturuldu\u011funda s\u00f6z konusu matrisin spesifik boyutlar\u0131n\u0131n ve talep edilen haznenin nihai boyutlar\u0131n\u0131n ayn\u0131 oldu\u011funu do\u011frulayan bir a\u00e7\u0131klama veya teyit ba\u015fvuru kapsam\u0131nda yer almamaktad\u0131r. Dolay\u0131s\u0131yla boyutsal ili\u015fki bak\u0131m\u0131ndan eksik bir ba\u011flant\u0131 mevcuttur.<\/p>\n<p>Y\u00fcksek Temyiz Kurulu\u2019nun\u00a0<a href=\"https:\/\/www.epo.org\/law-practice\/case-law-appeals\/recent\/g930001ex1.html\">G1\/93<\/a>\u00a0karar\u0131 uyar\u0131nca kapsam a\u015f\u0131m\u0131 ihlaline neden olan bir unsura sahip bir istemin bu haliyle muhafaza edilmesi m\u00fcmk\u00fcn de\u011fildir. Ancak yine EPC Md. 123(3) uyarr\u0131nca tescil sonras\u0131 bir istemin koruma kapsam\u0131 geni\u015fletilemez.\u00a0<a href=\"https:\/\/www.epo.org\/law-practice\/case-law-appeals\/recent\/g930001ex1.html\">G1\/93<\/a>\u00a0karar\u0131 bu durumu \u201c<b><u>ka\u00e7\u0131\u015f\u0131 olmayan tuzak<\/u><\/b>\u201d olarak adland\u0131rmaktad\u0131r. Patent sahibi\u00a0<a href=\"https:\/\/www.epo.org\/law-practice\/legal-texts\/html\/epc\/2016\/e\/ar123.html\">Md. 123(2)<\/a>\u00a0alt\u0131nda kapsam a\u015f\u0131m\u0131 ihlalini ortadan kald\u0131rmak i\u00e7in istemdeki kapsam a\u015f\u0131m\u0131 ihlalinin m\u00fcsebbibi unsuru yok etmeye\/\u00e7\u0131karmaya kalkt\u0131\u011f\u0131nda istemin koruma kapsam\u0131 geni\u015flemekte ve bu kez de\u00a0<a href=\"https:\/\/www.epo.org\/law-practice\/legal-texts\/html\/epc\/2016\/e\/ar123.html\">123(3)<\/a>\u00a0ihlali vuku bulmaktad\u0131r.\u00a0<a href=\"https:\/\/www.epo.org\/law-practice\/case-law-appeals\/recent\/g930001ex1.html\">G1\/93<\/a>\u00a0uyar\u0131nca bu durumun tek \u00e7\u00f6z\u00fcm\u00fc 123(2) ihlalini kald\u0131rmak i\u00e7in \u00e7\u0131kar\u0131lan unsurun yerine koruma kapsam\u0131n\u0131 ayn\u0131 bi\u00e7imde daraltan ve fakat tarifname taraf\u0131ndan orijinal metinde desteklenen bir unsur ilave etmektir.<\/p>\n<p>Mevcut patentte bu tan\u0131ma uyan bir muadil unsur bulunamad\u0131\u011f\u0131ndan patent \u201cka\u00e7\u0131\u015f\u0131 olmayan tuza\u011fa\u201d d\u00fc\u015fm\u00fc\u015f ve h\u00fck\u00fcms\u00fcz k\u0131l\u0131nm\u0131\u015ft\u0131r.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>EP 2 040 943\u00a0patenti \u0130tiraz Birimi taraf\u0131ndan d\u00fczeltilmi\u015f yap\u0131da muhafaza edilince itiraz sahibi temyize gitmi\u015ftir.
