Temyiz dosyas\u0131nda inceleme konusu ana talebe ili\u015fik ana istem a\u015fa\u011f\u0131daki formdad\u0131r:<\/p>\n

“Verfahren zur Leistungsregelung zumindest im hydrostatischen Arbeitsbetrieb eines Arbeitskomponenten aufweisenden Stra\u00dfenfertigers (F) oder Beschickers (B), der ein Prim\u00e4rantriebsaggregat (P) mit einem Verbrennungsmotor (M), vorzugsweise einem Dieselmotor, und mehreren Hydraulik-Verstellpumpen (4) aufweist, die hydraulisch mit gegebenenfalls als Verstellmotoren ausgef\u00fchrten Hydraulikmotoren (5, 8, 20, 17, 24) von Arbeitskomponenten verbunden sind, wobei eine computerisierte Steuervorrichtung (10) zur Betriebssteuerung eingesetzt wird, dadurch gekennzeichnet, dass der Verbrennungsmotor (M) von der Steuervorrichtung (10) innerhalb seines motorspezifischen Kennfeldes in Abh\u00e4ngigkeit vom Lastzustand (LZ) durch dynamische Drehzahlanpassung in oder bei einem verbrauchsoptimalen Kennfeldbereich (25) betrieben wird, und dass gleichzeitig zur Konstanthaltung der Volumenstr\u00f6me (V) f\u00fcr die Hydromotoren die Schluckvolumina (VsHP ) der Verstellpumpen (4) automatisch angepasst werden.”<\/p><\/blockquote>\n

Patent sahibinin arg\u00fcmanlar\u0131na g\u00f6re ana istem kar\u015f\u0131s\u0131nda en yak\u0131n \u00f6nceki teknik olarak kabul g\u00f6re D1 kar\u015f\u0131s\u0131nda bulu\u015f konusu alfaltlama makinas\u0131 D1’deki tek ama\u00e7 olan makinan\u0131n s\u00fcr\u00fc\u015f h\u0131z\u0131n\u0131 sabit tutma i\u015flevi kar\u015f\u0131s\u0131nda, hidrolik devrede sabit bir hacim ak\u0131\u015f\u0131 sa\u011flayarak farkl\u0131l\u0131k g\u00f6stermektedir. Bu nedenle hidrolik olarak sabit hacim ak\u0131\u015f\u0131 ile D1\u2019deki sabit s\u00fcr\u00fc\u015f h\u0131z\u0131 ayn\u0131 ve e\u015fit teknik zeminde g\u00f6r\u00fclmemelidir. Temyiz Kurulu\u2019nun g\u00f6r\u00fc\u015f\u00fcne g\u00f6re inceleme konusu patent ana istemi D1 kar\u015f\u0131s\u0131nda a\u015fa\u011f\u0131daki unsurlar bak\u0131m\u0131ndan ayr\u0131\u015fmaktad\u0131r:<\/p>\n

i) der Verbrennungsmotor von der Steuervorrichtung innerhalb seines motorspezifischen Kennfeldes in Abh\u00e4ngigkeit vom Lastzustand durch dynamische Drehzahlanpassung in oder bei einem verbrauchsoptimalen Kennfeldbereich betrieben wird, und,<\/p>\n

ii) dass gleichzeitig zur Konstanthaltung der Volumenstr\u00f6me f\u00fcr die Hydromotoren die Schluckvolumina der Verstellpumpen automatisch angepasst werden.<\/p><\/blockquote>\n

Bu \u00f6zellikler temel olarak: i) i\u00e7ten yanmal\u0131 motorun dinamik h\u0131z ayarlamas\u0131 ile y\u00fck durumunun bir fonksiyonu olarak \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131 ve ii) ayn\u0131 zamanda hidrolik motorlar\u0131n hacim ak\u0131\u015flar\u0131n\u0131 sabit tutmak i\u00e7in, de\u011fi\u015fken pompalar\u0131n emme hacimlerinin otomatik olarak ayarlanmas\u0131 prensiplerini a\u00e7\u0131klamaktad\u0131r.<\/p>\n

\u0130tiraz sahibi taraf olan temyiz sahibi D1’i inceleyen uzman kimsenin hidrolik devredeki hacim ak\u0131\u015f\u0131n\u0131n her zaman sabit kald\u0131\u011f\u0131n\u0131 varsayaca\u011f\u0131n\u0131 iddia etmektedir.
