EP 1 313 228<\/a>\u00a0ba\u015fvurusu \u0130nceleme Birimi taraf\u0131ndan reddedilmi\u015ftir. Ret gerek\u00e7esi ise EPC\u00a0Md. 87(1)<\/a>\u00a0kapsam\u0131nda \u201cayn\u0131 bulu\u015f\u201d kriterinin kar\u015f\u0131lanmamas\u0131 nedeniyle r\u00fc\u00e7han\u0131n d\u00fc\u015fmesi ve r\u00fc\u00e7han belgesinin ba\u015fvurunun aleyhine kullan\u0131lmas\u0131d\u0131r. \u0130nceleme konusu talebe ait \u0130stem 4 a\u015fa\u011f\u0131da verilmektedir:<\/p>\n

“A method, comprising:<\/p>\n

allocating a number of multi-codes, M, and a code offset, P; and<\/p>\n

formulating (S2) a codeword, the codeword comprising a code group indicator and an offset indicator, the code group indicator being equal to the minimum of M-1 and 15-M, the offset indicator being equal to the absolute value of P-1-((M\/8 rounded to the nearest lowest integer) multiplied by 15),<\/p>\n

wherein the formulated codeword comprises a compact representation of multi-code signaling, is decodable without the need for a look-up table, and comprises seven bits.”<\/p><\/blockquote>\n

Mevcut ba\u015fvuru, da\u011f\u0131n\u0131k spektrumlu haberle\u015fmede\u00a0mevcut\u00a0bir dizi \u00e7oklu kodun yan\u0131 s\u0131ra bir kod ofseti i\u00e7inde kullan\u0131lacak \u00e7oklu kod M veya m say\u0131s\u0131n\u0131 temsil eden bir kod s\u00f6zc\u00fc\u011f\u00fc olu\u015fturmak i\u00e7in bir y\u00f6ntem ile ilgilidir. \u0130lk \u00e7oklu kodun kod setindeki konumu kompakt bi\u00e7imde P veya Delta ofseti ile g\u00f6sterilmektedir.<\/p>\n

Bilindi\u011fi gibi EPC\u00a0Md. 87(1)<\/a>\u2019deki \u201cayn\u0131 bulu\u015f\u201d testi EPC Md.\u00a0123(2)<\/a>\u2019deki “kapsam a\u015f\u0131m\u0131” testi ile ayn\u0131d\u0131r. E\u011fer konu hakk\u0131nda uzman kimse ikinci ba\u015fvurudaki bulu\u015fu a\u00e7\u0131k ve tart\u0131\u015fmaya yer vermeyecek bi\u00e7imde birinci r\u00fc\u00e7han ba\u015fvurusundaki bulu\u015ftan \u00e7\u0131karsayabiliyorsa \u201cayn\u0131 bulu\u015f\u201d kavram\u0131 kar\u015f\u0131lan\u0131r. Aksi takdirde kapsam a\u015f\u0131m\u0131 durumunda oldu\u011fu gibi uzman kimse yeni teknik i\u00e7erikle kar\u015f\u0131 kar\u015f\u0131yad\u0131r ve ayn\u0131 bulu\u015f s\u00f6z konusu de\u011fildir (G2\/98<\/a>).<\/p>\n

Ba\u015fvurudaki 4, 11 ve 16 numaral\u0131 istemler 2 numaral\u0131 kodlama sistemine dayanmaktad\u0131r. Buna g\u00f6re s\u0131ras\u0131yla grup kodu g\u00f6stergesinin ve ofset g\u00f6stergesinin belirlenmesi i\u00e7in, (i) minimum M-1 ve 15-M ve (ii) M \/ 8’in en yak\u0131n alt tam say\u0131ya yuvarlanm\u0131\u015f olarak belirlenmesi kurallar\u0131 tan\u0131mlanmaktad\u0131r. Ne var ki bu form\u00fcller r\u00fc\u00e7han al\u0131nan ba\u015fvuruda yer almamaktad\u0131r. R\u00fc\u00e7han ba\u015fvurusunda benzer form\u00fcller vard\u0131r ancak bire bir ayn\u0131 de\u011fillerdir. Temyiz sahibi r\u00fc\u00e7han ba\u015fvurusundaki bulu\u015fun kasten dar tutulmad\u0131\u011f\u0131n\u0131 ve daha kapsay\u0131c\u0131 oldu\u011funu, bu nedenle ikinci bulu\u015fu zaten kapsad\u0131\u011f\u0131n\u0131 iddia etmektedir. Ancak kurulun g\u00f6r\u00fc\u015f\u00fcne g\u00f6re bir matematik form\u00fcl\u00fcn\u00fcn tam olarak belirlenmesi kapsam\u0131n geni\u015fletilip daralt\u0131lmas\u0131n\u0131n \u00f6tesinde bir belirsizlik i\u00e7ermektedir. Ayr\u0131ca ilk ba\u015fvuru ikinci ba\u015fvuruyu teknik kapsam olarak kapsasa bile uzman kimse yeni teknik i\u00e7erikle kar\u015f\u0131la\u015f\u0131yorsa bulu\u015f de\u011fi\u015fmi\u015f demektir.<\/p>\n

R\u00fc\u00e7han belgesinin kar\u015f\u0131 teknik olarak kullan\u0131lmas\u0131 neticesinde ba\u011f\u0131ms\u0131z istemler bulu\u015f basama\u011f\u0131ndan yoksun kabul edilmi\u015f ve ba\u015fvurunun reddi karar\u0131 onanm\u0131\u015ft\u0131r.<\/p>\n","protected":false},"excerpt":{"rendered":"
