Tescil edilen istem a\u015fa\u011f\u0131dad\u0131r:<\/p>\n<blockquote><p>&#8220;An isotactic propylene homopolymer having:<\/p>\n<p>more than 15 and less than 90 regio defects (sum of 2,1-erythro and 2,1-threo insertions and 3,1- isomerizations, as measured by **(13)C-NMR) per 10,000 propylene units;<\/p>\n<p>an Mw (weight average molecular weight) of 50,000 g\/mol or more;<\/p>\n<p>a peak melting temperature, Tmp (as measured by DSC, as described in paragraph [0107]), of greater than 149 \u00b0C;<\/p>\n<p>an mmmm pentad fraction of 0.85 or more;<\/p>\n<p>a heat of fusion of 80 J\/g or more; and<\/p>\n<p>a Tmp-Tcp &lt;= (0.907 x Tmp) &#8211; 99.64, as measured in \u00b0C on the homopolymer having 0 wt% nucleating agent, wherein Tcp is the peak crystallization temperature (as measured by DSC, as described in pararaph (sic) [0107]).&#8221;<\/p><\/blockquote>\n<p>\u0130tiraz s\u0131ras\u0131nda sunulan en yak\u0131n \u00f6nceki teknik D2 yay\u0131n\u0131d\u0131r. D2\u2019nin ile D1 kombinasyonu da ana istemin fark \u00f6zelliklerine eri\u015fmekte yard\u0131mc\u0131 olmamaktad\u0131r. Bu nedenlerle ana istem bulu\u015f basama\u011f\u0131 testini ge\u00e7mi\u015f olarak kabul edilmi\u015ftir.<\/p>\n<p>Temyiz Kurulu yapt\u0131\u011f\u0131 de\u011ferlendirmede \u0130tiraz Birimi taraf\u0131ndan uygulanan problem-\u00e7\u00f6z\u00fcm yakla\u015f\u0131m\u0131n\u0131n yerle\u015fik i\u00e7tihada uygun olmad\u0131\u011f\u0131 ve objektif teknik problemin, yani \u00f6nceki teknik kar\u015f\u0131s\u0131nda ay\u0131rt edici unsura dayal\u0131 olarak tan\u0131mlanan teknik problemin i\u00e7tihada ayk\u0131r\u0131 bi\u00e7imde \u00e7\u00f6z\u00fcm\u00fcn kendisine ait \u00f6nermeler i\u00e7erdi\u011fi g\u00f6r\u00fc\u015f\u00fc has\u0131l olmu\u015ftur.<\/p>\n<p>Temyiz Kurulu\u2019nun incelemesine g\u00f6re tarifname tak\u0131m\u0131 incelendi\u011finde bu t\u00fcr bir &#8220;daha h\u0131zl\u0131 kristalizasyon&#8221; hakk\u0131nda net bir kan\u0131t bulunmamaktad\u0131r. Kristalle\u015fmenin daha y\u00fcksek bir s\u0131cakl\u0131kta ba\u015flad\u0131\u011f\u0131n\u0131 kabul ederek, i\u015flemin ba\u015flad\u0131ktan sonra izotermal veya izotermal olmayan ko\u015fullar alt\u0131nda di\u011fer propilen homopolimerlerinden daha h\u0131zl\u0131 ger\u00e7ekle\u015fti\u011fine dair herhangi bir veri bulunmad\u0131\u011f\u0131ndan objektif teknik problem \u201calternatif propilen homopolimerlerinin sa\u011flanmas\u0131\u201d olarak form\u00fcle edilmelidir.<\/p>\n<p>S\u00f6z konusu problemin \u201cartt\u0131r\u0131lm\u0131\u015f bir kristalizasyon s\u0131cakl\u0131\u011f\u0131na sahip olan homopolypropilen elde edilmesi\u201d yerine \u201calternatif propilen homopolimerlerinin sa\u011flanmas\u0131\u201d bulu\u015f basama\u011f\u0131 analizini tamamen de\u011fi\u015ftirmektedir. Bu de\u011ferlendirmeden hareketle \u201calternatif propilen homopolimerlerinin sa\u011flanmas\u0131\u201d teknik probleminin \u00e7\u00f6z\u00fcm\u00fcn\u00fcn konu hakk\u0131nda uzman kimsenin genel yayg\u0131n bilgisine ba\u015fvurmak suretiyle a\u015fikar bi\u00e7imde ana istemdeki fark unsurlara ula\u015fmaya izin verece\u011fi de\u011ferlendirilmi\u015f ve patent iptal edilmi\u015ftir.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>EP 2 231 726\u00a0patentine yap\u0131lan itiraz \u0130tiraz Birimi taraf\u0131ndan reddedilmi\u015ftir.
