Stereo g\u00f6r\u00fcnt\u00fcleme \u00fcnitesinde, optik sistemlerin her birinin diyagonal a\u00e7\u0131s\u0131 omega1, her iki optik sistemin optik eksenlerinin nesneye g\u00f6re yapt\u0131\u011f\u0131 a\u00e7\u0131 alfa ve stereo g\u00f6r\u00fcnt\u00fcleme birimindeki bir g\u00f6zlem g\u00f6r\u00fcnt\u00fcs\u00fcn\u00fcn diyagonal mesafesi ise L olarak tan\u0131mlanm\u0131\u015ft\u0131r.<\/p>\n<p>Patent sahibi, itiraz eden temyiz sahibinin konu hakk\u0131nda uzman kimsenin x, omega1 ve L de\u011ferlerinin birbirlerine g\u00f6re nas\u0131l ayar edileceklerini bilemeyece\u011fi hakk\u0131ndaki arg\u00fcman\u0131na cevaben uzman kimsenin ortak yayg\u0131n bilgisine at\u0131f yaparak ilgili bilginin E. Hecht\u2019in yazar\u0131 oldu\u011fu 1989 tarihli\u00a0\u00a0&#8220;Optik&#8221; ders kitab\u0131ndan hareketle bilinir oldu\u011funu ifade etmektedir.<\/p>\n<p>\u0130nceleme konusu ana istem a\u015fa\u011f\u0131dad\u0131r:<\/p>\n<blockquote>\n<p>&#8220;A medical stereo observation system comprising:<\/p>\n<p>a stereo imaging unit (135; 165) having a first imaging optical system (143L; 174L) for producing a first image for a left eye and a second imaging optical system (143R; 174R) for producing a second image for a right eye, the first image and the second image mutually having parallax; and<\/p>\n<p>a stereo display unit (136; 167) for displaying stereoscopically the images produced by the stereo imaging unit,<\/p>\n<p>focal positions of the first imaging optical system and the second imaging optical system being located on an object side of an intersection of optical axes of the first imaging optical system and the second imaging optical system,<\/p>\n<p>characterized in that the following condition is satisfied:<\/p>\n<p>{5.9 x WD x tan(omega1\/2)}\/{L x tan(alpha\/2) + 5.9 x tan(omega1\/2)}<\/p>\n<p>&lt;= x (mm) &lt;=<\/p>\n<p>{21.7 x WD x tan(omega1\/2)}\/{L x tan(alpha\/2) + 21.7 x tan(omega1\/2)}<\/p>\n<p>where x is a distance from the intersection of the optical axes of the first imaging optical system and the second imaging optical system to a straight line connecting a center of an object-side focal plane of the first imaging optical system with a center of an object-side focal plane of the second imaging optical system,<\/p>\n<p>WD is a working distance of the stereo imaging unit, which is defined as a distance from a most object-side surface of the stereo imaging unit to object-side focal positions of the stereo imaging unit,<\/p>\n<p>omega1 is a diagonal field angle of each of the first imaging optical system and the second imaging optical system,<\/p>\n<p>alpha is an angle made on the object side by the optical axes of the first and second imaging optical systems, and<\/p>\n<p>L is a diagonal distance of an observation image in the stereo display unit.&#8221;<\/p>\n<\/blockquote>\n<p>&nbsp;<\/p>\n<p>\u0130tiraz Birimi s\u00f6z konusu patentin a\u00e7\u0131klama yetersizli\u011fi kusuruna yol a\u00e7mad\u0131\u011f\u0131 karar\u0131na dayanak olarak uzman kimsenin \u0130stem 1\u2019i yorumlarken WD ve L&#8217;nin mm cinsinden ifade edilmesi gere\u011fini fark edece\u011fini de\u011ferlendirmi\u015ftir. Bu karara g\u00f6re, her ne kadar patent, \u0130stem 1&#8217;de tan\u0131mlanan e\u015fitsizli\u011fin nas\u0131l t\u00fcretildi\u011fini veya paydan\u0131n eklenmesi ile yap\u0131lan i\u015flemin nas\u0131l olup da bir uzunluk birimiyle sonu\u00e7lanabilece\u011fini a\u00e7\u0131klamam\u0131\u015f olsa da, uzman ki\u015fi, istem konusu e\u015fitsizlikte tan\u0131mlanan ko\u015ful kar\u015f\u0131lanacak bi\u00e7imde uygun parametreleri se\u00e7ecektir.<\/p>\n<p>Patent sahibi bir patentin uygulama yetersizli\u011fine sahip olmas\u0131na karar k\u0131labilmek i\u00e7in gerekli ko\u015fulun uzman kimsenin bulu\u015f konusunu ger\u00e7ekle\u015ftirmesinin m\u00fcmk\u00fcn olmamas\u0131 oldu\u011funu ifade etmektedir. Yine patent sahibi\u00a0<a href=\"https:\/\/www.epo.org\/law-practice\/case-law-appeals\/recent\/t090593eu1.html\">T 593\/09<\/a>\u00a0karar\u0131na at\u0131f yaparak uzman kimsenin WD ve L parametrelerine metre olarak m\u0131 yoksa milimetre cinsinden mi de\u011fer girilmesi konusunda ku\u015fkuya d\u00fc\u015fmesinin EPC\u00a0<a href=\"https:\/\/www.epo.org\/law-practice\/legal-texts\/html\/epc\/2016\/e\/ar83.html\">Md. 83<\/a>\u00a0alt\u0131nda bir a\u00e7\u0131klama yetersizli\u011fi ihlali de\u011fil olsa olsa\u00a0<a href=\"https:\/\/www.epo.org\/law-practice\/legal-texts\/html\/epc\/2016\/e\/ar84.html\">Md. 84<\/a>\u00a0alt\u0131nda bir a\u00e7\u0131kl\u0131k ihlali olabilece\u011fini ifade etmektedir.
