Temyiz sahibi taraf\u0131ndan dosyalanan ana talebe ili\u015fik ana istem a\u015fa\u011f\u0131da unsur gruplar\u0131 numaraland\u0131r\u0131lm\u0131\u015f bi\u00e7imde verilmektedir:<\/p>\n

1- “Verfahren zur Applikation wenigstens eines Wirkstoffs<\/p>\n

in zum Abduschen des K\u00f6rpers eines Lebewesens vorgesehenes Wasser, das einen Duschkopf durchstr\u00f6mt, der eine durch Durchstr\u00f6m\u00f6ffnungen durchstr\u00f6mbare Aufnahmekammer f\u00fcr eine Wirkstoffdarreichung aufweist, wobei<\/p>\n

2- w\u00e4hrend des Duschvorgangs die Wirkstoffdarreichung mit<\/p>\n

durchstr\u00f6mbaren Gebinden f\u00fcr jeweils eine Anwendung erfolgen soll,<\/p>\n

3- die durchstr\u00f6mbaren Gebinde Pflanzenbestandteile und\/<\/p>\n

oder Pflanzenextrakte enthalten und<\/p>\n

4- durch durchstr\u00f6mbare Kapseln, Filterbeutel oder Pads<\/p>\n

gebildet werden,<\/p>\n

5- vor jedem Duschvorgang, bei dem Wirkstoffe dem K\u00f6rper<\/p>\n

zugef\u00fchrt werden sollen, der Duschkopf ge\u00f6ffnet, das Gebinde eingelegt und die Aufnahmekammer mit Ausnahme der Durchstr\u00f6m\u00f6ffnungen wasserdicht verschlossen wird,<\/p>\n

6- eine dosierte Wirkstoffabgabe dadurch erfolgen soll,<\/p>\n

dass der Wirkstoff w\u00e4hrend des Duschvorgangs aus dem Gebinde abgegeben wird, bis die Wirkstoffdarreichung aufgebraucht ist, und<\/p>\n

7- nach dem Duschvorgang oder vor dem n\u00e4chsten<\/p>\n

Duschvorgang, mit dem eine gezielte Wirkstoffabgabe wieder erfolgen soll, das Gebinde entnommen wird.”<\/p><\/blockquote>\n

S\u00f6z konusu ana istem bir canl\u0131n\u0131n suyla y\u0131kanmas\u0131\/du\u015f almas\u0131 s\u0131ras\u0131nda suyun i\u00e7ine kar\u0131\u015ft\u0131r\u0131lan aktif bir bile\u015fenin uygulanma usul\u00fcne ili\u015fkindir. Temyiz Kurulu\u2019nun de\u011ferlendirmesine g\u00f6re her ne kadar \u0130stem 1\u2019de a\u00e7\u0131klanan aktif bile\u015fen \u0130stem 5\u2019ten hareketle farmas\u00f6tik olarak aktif bir bile\u015fen olsa da usul asl\u0131nda EPC Md. 53(c) kapsam\u0131nda insan veya hayvan v\u00fccudunda uygulanan bir te\u015fhis, tedavi y\u00f6ntemleri veya cerrahi y\u00f6ntemlerin kapsam\u0131na girmemektedir zira s\u00f6z konusu y\u00f6ntem bir du\u015f s\u0131ras\u0131nda suya kar\u0131\u015ft\u0131r\u0131lan bir bile\u015fen ile ilgili bir usuld\u00fcr. Temyiz Kurulu ayn\u0131 zamanda\u00a0G1\/07<\/a>\u00a0Y\u00fcksek Temyiz Heyeti karar\u0131nda tan\u0131mlanan cerrahi usullere ili\u015fkin kriterlerin de mevcut dosya ile ilgili olamayaca\u011f\u0131na h\u00fckmetmi\u015ftir.<\/p>\n
