Temyiz incelemesine konu ana istem a\u015fa\u011f\u0131da verilmektedir:<\/p>\n<blockquote><p>&#8220;Background elimination device (1) for detecting the presence of an object within a pre-determined interval of distances contained between the background elimination device (1) itself and a pre-determined limit threshold;<\/p>\n<p>the background elimination device (1) comprises:<\/p>\n<p>&#8211; a photoemitter (3) which emits a beam of light pulses in a pre-determined direction;<\/p>\n<p>&#8211; a photoreceiver (4) which receives a beam of light pulses reflected by an object and supplies as output a pair of position signals which indicate the distance of the object (2) from the background elimination device (1); said photoreceiver (4) having a surface (7) which is sensitive to the position of the incident light beam and comprises a first and second output terminal (8,9) to provide for said position signals;<\/p>\n<p>&#8211; a pair of amplification channels (14, 15), which amplifies said position signals, and processing means (6) which receives said position signals from the photoreceiver (4) via the amplification channels (14, 15), and, according to the position signals supply as output a first information signal which indicates the arrangement of an object (2) within said pre-determined interval of distances;<\/p>\n<p>the background elimination device (1) being characterised in that it comprises:<\/p>\n<p>&#8211; preliminary search means (22) which process temporarily only one of the position signals in order to supply as output a second information signal which indicates only the presence\/absence of an object (2) independently from the distance of the object (2) from the background elimination device (1); and<\/p>\n<p>&#8211; means for carrying out a comparison between the first and the second information signal, in order to verify the arrangement of the object within said predetermined interval of distances.&#8221;<\/p><\/blockquote>\n<p>Mevcut bulu\u015f \u00f6ng\u00f6r\u00fclm\u00fc\u015f bir mesafedeki objeleri tespit eden ve \u00f6ng\u00f6r\u00fclm\u00fc\u015f mesafenin \u00f6tesindeki uzakl\u0131klara tekab\u00fcl eden objeleri yok sayan bir arka plan ortadan kald\u0131rma ve obje tespit y\u00f6ntemine ili\u015fkindir. Buna g\u00f6re bir \u0131\u015f\u0131k kayna\u011f\u0131 bir \u0131\u015f\u0131k demetini inceleme b\u00f6lgesine yans\u0131t\u0131r. \u00dczerine incelenen b\u00f6lgeden bir nesneden yans\u0131yan bir \u0131\u015f\u0131\u011f\u0131n d\u00fc\u015ft\u00fc\u011f\u00fc bir foto al\u0131c\u0131s\u0131 mevcuttur. G\u00f6r\u00fcnt\u00fclenen noktan\u0131n konumunu belirlemek i\u00e7in \u00e7e\u015fitli tipte foto al\u0131c\u0131lar kullan\u0131labilir. \u00d6rne\u011fin, iki elemanl\u0131 bir fotodiyot detekt\u00f6r\u00fc (Dl&#8217;de a\u00e7\u0131kland\u0131\u011f\u0131 gibi), birbirine biti\u015fik olarak monte edilen iki ayr\u0131 fotodiyot i\u00e7erir. Her bir fotodiyottan elde edilen \u00e7\u0131kt\u0131, o fotodiyotta meydana gelen \u0131\u015f\u0131k miktar\u0131n\u0131 temsil eder. Uygun bir foto al\u0131c\u0131s\u0131na ait ba\u015fka bir \u00f6rnek ise her bir ucunda tek bir \u0131\u015f\u0131\u011fa duyarl\u0131 y\u00fczeye ve bir \u00e7\u0131k\u0131\u015fa sahip olan bir pozisyon alg\u0131lay\u0131c\u0131 detekt\u00f6r veya PSD&#8217;dir (position-sensing detector; D3&#8217;te a\u00e7\u0131kland\u0131\u011f\u0131 gibi). Her \u00e7\u0131k\u0131\u015ftaki ak\u0131m miktar\u0131, g\u00f6r\u00fcnt\u00fclenen noktan\u0131n dedekt\u00f6r \u00fczerindeki konumuyla orant\u0131l\u0131d\u0131r. Her iki durumda da, \u0131\u015f\u0131k \u00e7\u0131k\u0131\u015f\u0131n\u0131n foto al\u0131c\u0131daki konumunu belirlemek i\u00e7in iki \u00e7\u0131k\u0131\u015f sinyali aras\u0131ndaki fark kullan\u0131l\u0131r.<\/p>\n<p>Patent sahibi itiraz sahibinden farkl\u0131 olarak \u0130stem 1\u2019deki PSD cihaz\u0131n\u0131n D1\u2019deki iki elemanl\u0131 foto al\u0131c\u0131 ile ayn\u0131 olmad\u0131\u011f\u0131n\u0131 ifade etmektedir. Ancak Temyiz Kurulu bu ayr\u0131m\u0131n bulu\u015f basama\u011f\u0131 incelemesinde fark yaratmayaca\u011f\u0131n\u0131 de\u011ferlendirmi\u015ftir.<\/p>\n<p>\u0130tiraz sahibi, D1&#8217;de de bir nesnenin, yans\u0131t\u0131lan \u0131\u015f\u0131k huzmesinin g\u00f6r\u00fc\u015f hatt\u0131 boyunca bir yerde olup olmad\u0131\u011f\u0131n\u0131 belirlemek i\u00e7in bir toplama eleman\u0131n\u0131n (14) yer ald\u0131\u011f\u0131n\u0131 belirtmektedir. \u00d6zellikle, iki fotodiyotun \u00e7\u0131k\u0131\u015flar\u0131ndan gelen sinyallerin toplam\u0131 \u00f6nceden belirlenmi\u015f bir e\u015fik de\u011ferden fazlaysa, bir nesnenin mevcut oldu\u011fu sonucuna var\u0131lmaktad\u0131r. Bir nesnenin mevcut oldu\u011funu belirledikten sonra, nesnenin ilgi alan\u0131nda bulunup bulunmad\u0131\u011f\u0131 diferansiyel eleman (13) kullan\u0131larak olu\u015fturulabilir. Yans\u0131yan \u0131\u015f\u0131k noktas\u0131 her iki fotodiyotta da meydana geldi\u011finde, her iki \u00e7\u0131k\u0131\u015f terminali de s\u0131f\u0131rdan farkl\u0131 bir sinyal \u00fcretir. B\u00f6ylece D1\u2019deki toplama eleman\u0131n\u0131n (14) D1\u2019de anlat\u0131lan bulu\u015fun \u00e7al\u0131\u015fmas\u0131 i\u00e7in elzem bir unsur oldu\u011fu ortaya \u00e7\u0131kmaktad\u0131r.<\/p>\n<p>Temyiz Kurulu D1 veya D3 incelendi\u011finde kullan\u0131lan sens\u00f6rlerden herhangi birinde yer alan toplama devresinden vazge\u00e7mek i\u00e7in bir i\u015faret olmad\u0131\u011f\u0131n\u0131 ve bir nesnenin varl\u0131\u011f\u0131n\u0131 veya yoklu\u011funu belirlemek i\u00e7in \u00e7\u0131k\u0131\u015f sinyallerinden sadece birini i\u015flemenin yeterli olaca\u011f\u0131na dair herhangi bir \u00f6neri olmad\u0131\u011f\u0131n\u0131 not etmektedir. Bu t\u00fcr bir i\u015faretin yoklu\u011funda, nesnenin varl\u0131\u011f\u0131n\u0131 veya yoklu\u011funu g\u00f6stermek i\u00e7in konum sinyallerinden sadece birini ge\u00e7ici olarak i\u015fleyen bir \u00f6n arama arac\u0131 i\u00e7erecek \u015fekilde D1 cihaz\u0131n\u0131n de\u011fi\u015ftirilmesi ve bu \u015fekilde \u0130stem 1 i\u00e7eri\u011fine ula\u015f\u0131lmas\u0131 a\u015fikar bir de\u011fi\u015fiklik olmad\u0131\u011f\u0131ndan bulu\u015f niteli\u011fi teslim edilmi\u015ftir.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>10.01.2020 \/T\u00a02289\/13\u00a0\/DETECTION OF AN OBJECT\u00a0\/DATALOGIC EP 1 209 487\u00a0patenti i\u00e7in yap\u0131lan itiraz reddedilmi\u015ftir.
