EP 2 163 271<\/a>\u00a0numaral\u0131 ba\u015fvuru \u0130tiraz Birimi taraf\u0131ndan iptal edilmi\u015ftir. \u0130tiraz Birimi inceleme konusu istemin EPC\u00a0Md. 53(c)<\/a>\u00a0gereklerini kar\u015f\u0131lad\u0131\u011f\u0131n\u0131 ancak bulu\u015f basama\u011f\u0131na sahip olmad\u0131\u011f\u0131n\u0131 belirlemi\u015ftir. Temyiz incelemesine konu olan ana istem a\u015fa\u011f\u0131dad\u0131r:<\/p>\n

“1. [1.1] A method for measuring the adequacy parameters that are achieved during a kidney substitution treatment,<\/p>\n

– [1.2] wherein the kidney substitution treatment is provided by a machine, which has an extracorporeal blood system pumping the patient blood at a set blood flow rate through the blood chamber of a dialyzer, divided by a semi-permeable membrane into the blood chamber and a dialyzing fluid chamber, the dialyzing fluid flows at a preset flow rate through the dialyzing fluid system of the machine and collects the waste products from the patient after flowing through the dialyzing fluid chamber of the dialyzer,<\/p>\n

– [1.3] wherein a device able to measure continuously a kidney substitution treatment related waste product is mounted in the dialyzing fluid system of the kidney substitution treatment machine,<\/p>\n

– [1.4] wherein the data provided by the kidney substitution treatment machine is used to measure the adequacy parameters at the end of the kidney substitution treatment,<\/p>\n

– [1.5] wherein the data provided by the device able to measure continuously any kidney substitution treatment waste product is split in subsets to be used to determine the adequacy parameters achieved during the kidney substitution treatment with an algorithm,<\/p>\n

– [1.6] wherein a data interface is implemented between the kidney substitution treatment machine and the measuring device in order to register machine events to be considered in the algorithm for the determination of the adequacy parameters, and<\/p>\n

– [1.7] wherein the measuring algorithm is based on a kind of non linear fitting procedure for each of the data subsets with or without considering any kind of event happening on the dialysis machine.”<\/p><\/blockquote>\n

Patent sahibinin arg\u00fcmanlar\u0131na g\u00f6re bulu\u015f bir b\u00f6brek ikame tedavisi s\u0131ras\u0131nda ba\u015fvurulan yeterlilik parametrelerini \u00f6l\u00e7mek ve belirlemek i\u00e7in bir y\u00f6ntem ile ilgili olup ana istem herhangi bir tedavi veya cerrahi i\u015fleme y\u00f6nelik bir ad\u0131m tan\u0131mlamamaktad\u0131r. Yeterlilik parametrelerini belirlemek i\u00e7in ba\u015fvurulan ad\u0131mlarlar ile tedavi veya cerrahi i\u015flevler aras\u0131nda i\u015flevsel bir ba\u011flant\u0131 bulunmamaktad\u0131r. Dolay\u0131s\u0131yla\u00a0T 245\/87<\/a>\u00a0karar\u0131 uyar\u0131nca b\u00f6yle bir i\u015flevsel ba\u011flant\u0131n\u0131n bulunmamas\u0131 nedeniyle EPC Md. 53 ihlali s\u00f6z konusu olmamaktad\u0131r.<\/p>\n

Di\u011fer yandan Temyiz Kurulu bu g\u00f6r\u00fc\u015fe kat\u0131lmam\u0131\u015ft\u0131r, zira istem do\u011frudan bir tedavi i\u015flemine at\u0131f yapmaktad\u0131r. Ayr\u0131ca 1.1 unsuru hastaya ait kan\u0131n belirli bir h\u0131zda pompalanmas\u0131 unsurunu a\u00e7\u0131klamaktad\u0131r; bu a\u00e7\u0131k\u00e7a diyaliz i\u015flemi s\u0131ras\u0131nda ger\u00e7ekle\u015ftirilen ak\u0131\u015f\u0131n ta kendisidir. Kurul g\u00f6r\u00fc\u015f\u00fcne g\u00f6re istem \u00f6nce diyaliz i\u015flemini uygulayan daha sonra da performans de\u011ferlerini \u00f6l\u00e7en bir usule ili\u015fkindir. \u0130stemin \u201cperformans de\u011ferlerinin \u00f6l\u00e7\u00fclmesi i\u00e7in bir usul\u201d \u015feklinde isim verilerek tan\u0131mlanmas\u0131 i\u00e7indeki te\u015fhis ve tedavi usul\u00fc ad\u0131mlar\u0131n\u0131n mevcudiyetini de\u011fi\u015ftirmemektedir.<\/p>\n

Bu nedenlerle \u0130tiraz Birimi\u2019nin iptal gerek\u00e7esine g\u00f6re Temyiz Kurulu\u2019nun iptal gerek\u00e7esi farkl\u0131 olmakla birlikte iptal karar\u0131 onanm\u0131\u015ft\u0131r.<\/p>\n","protected":false},"excerpt":{"rendered":"
