Bu durumda ana istem kapsam\u0131na d\u00fc\u015fen ve patent tarifnamesinde iyi sonu\u00e7 ile ili\u015fkilendirilmi\u015f bir \u00f6rne\u011fin beklenen etkiyi \u00fcretmedi\u011fi anla\u015f\u0131ld\u0131\u011f\u0131ndan EPC\u00a0<a href=\"https:\/\/www.epo.org\/law-practice\/legal-texts\/html\/epc\/2016\/e\/ar83.html\">Md. 83<\/a>\u00a0kusuru olu\u015fmu\u015ftur.<\/p>\n<p><u>Patent sahibinin<\/u>\u00a0arg\u00fcmanlar\u0131 uyar\u0131nca\u00a0D1 en yak\u0131n \u00f6nceki tekni\u011fi temsil etmekte olup \u0130stem 1 D1\u2019den d) k\u0131sm\u0131ndaki polimerik bile\u015fen bak\u0131m\u0131ndan ayr\u0131\u015fmaktad\u0131r.\u00a0\u00a0Patent sahibine g\u00f6re d) bile\u015feni istem konusu bile\u015fime yeni \u00f6zellikler vermekte,\u00a0\u00a0uygulama s\u0131cakl\u0131\u011f\u0131nda viskoziteyi d\u00fc\u015f\u00fcrmekle birlikte so\u011fuduktan sonra d\u00fc\u015f\u00fck kesme h\u0131z\u0131nda \u00f6l\u00e7\u00fclen viskozitenin y\u00fckselmesini sa\u011flamaktad\u0131r. \u0130laveten tiksotropi g\u00f6zlemlenmektedir.\u00a0Bu \u00f6zellikler tarifnamede Tablo 1 ve 3&#8217;te g\u00f6sterilmi\u015ftir. Yine bu sayede bile\u015fim, uygulanmas\u0131ndan hemen sonra y\u0131kamaya kar\u015f\u0131 diren\u00e7li k\u0131l\u0131nm\u0131\u015ft\u0131r. D1 bile\u015fimlerinin aksine, bir \u00f6n jelle\u015ftirme a\u015famas\u0131 gerektirmemektedir. So\u011futulduktan sonra test edilen bile\u015fimlerden birinin inceleme konusu patente ait paragraf 12&#8217;de belirtildi\u011fi gibi 19.000 Pas viskoziteye sahip olmad\u0131\u011f\u0131 do\u011fru olmakla birlikte, bu de\u011fer y\u0131kama direncini elde etmek i\u00e7in spesifik bir e\u015fik de\u011feri de\u011fil, tercih edilen bir gerekliliktir. Bile\u015fim daha uzun bir s\u00fcre beklemeye b\u0131rak\u0131l\u0131rsa viskozitede daha fazla art\u0131\u015f da meydana gelebilmekte olup, daha y\u00fcksek s\u0131cakl\u0131kta ve so\u011futmadan sonra viskozite fark\u0131 da dikkate al\u0131nmal\u0131d\u0131r.<\/p>\n<p>Bulu\u015f basama\u011f\u0131 analizi\u00a0<u>patent sahibi<\/u>\u00a0taraf\u0131ndan \u015fu \u015fekilde uygulanmaktad\u0131r: D1&#8217;den ba\u015flayarak, altta yatan teknik problem, y\u00fcksek statik ve dinamik mukavemete ve iyi bir korozyon direncine sahip, k\u00fcrlenmi\u015f bir \u00fcr\u00fcnle sonu\u00e7lanan bir epoksi yap\u0131\u015fkan bile\u015fiminin sa\u011flanmas\u0131d\u0131r; ayn\u0131 \u015fekilde \u00f6n k\u00fcrleme ad\u0131m\u0131na gerek b\u0131rakmayan ve kullan\u0131m\u0131 \u00e7ok basit bir epoksi yap\u0131\u015fkan bile\u015fiminin sa\u011flanmas\u0131d\u0131r. Bu problemle kar\u015f\u0131la\u015fan meslek erbab\u0131 \u00f6nceki teknikte, D1&#8217;de tan\u0131mland\u0131\u011f\u0131 gibi bir kompozisyona \u0130stem l&#8217;de tan\u0131mland\u0131\u011f\u0131 gibi bir polimerik bile\u015fen d) dahil edilmesine dair herhangi bir \u00f6neri yapamaz.<\/p>\n<p><u>\u0130tiraz sahibinin<\/u>\u00a0bulu\u015f basama\u011f\u0131 problem-\u00e7\u00f6z\u00fcm yakla\u015f\u0131m\u0131 ise \u015fu \u015fekildedir: D1 \u00f6nceki teknikte en yak\u0131n yay\u0131nd\u0131r ve \u0130stem 1 &#8216;deki gibi bir yap\u0131\u015ft\u0131r\u0131c\u0131 bile\u015fimi olup, \u0130stem 1\u2019den polimerik bile\u015fen d)&#8217;yi i\u00e7ermesiyle ayr\u0131\u015fmaktad\u0131r. \u0130ncelenen patentte Tablo 3&#8217;te g\u00f6r\u00fclece\u011fi gibi, d) bile\u015feninin tan\u0131m\u0131na giren t\u00fcm polimerlerin s\u00f6zde teknik etkiyi \u00fcretti\u011fi s\u00f6ylenemez. \u00d6rnek BM 1460.002&#8217;nin bile\u015fiminin viskozitesi, kar\u015f\u0131la\u015ft\u0131rmal\u0131 \u00f6rnek BM 1480&#8217;den (1.300&#8217;e kar\u015f\u0131 5000 Pas) bile daha d\u00fc\u015f\u00fckt\u00fcr. Temyiz sahibinin iddialar\u0131n\u0131n aksine, bu bile\u015fimin viskozitesinin zaman i\u00e7inde artmas\u0131 ve patentin ilgili paragraf\u0131na g\u00f6re bile\u015fime y\u0131kama direncini vermek i\u00e7in gerekli olan de\u011fere ula\u015fmas\u0131 beklenemez. Bu nedenle, Dl&#8217;den ba\u015flayarak, altta yatan teknik problem, patent sahibi taraf\u0131ndan \u00f6nerildi\u011fi gibi form\u00fcle edilemez. Teknik problem daha az iddial\u0131 bir problem olarak, yani alternatif bir yap\u0131\u015fkan kompozisyonun sa\u011flanmas\u0131 olarak form\u00fcle edilmelidir. Bu problemle kar\u015f\u0131 kar\u015f\u0131ya kalan meslek erbab\u0131 ise D1&#8217;in bile\u015fimine, \u0130stem l&#8217;in d) bile\u015feni gibi bir polimerik bile\u015fen dahil etmeyi mutlaka d\u00fc\u015f\u00fcn\u00fcrd\u00fc zira bu bile\u015fenler, D14 teknik veri sayfas\u0131nda g\u00f6sterildi\u011fi gibi, yap\u0131\u015ft\u0131r\u0131c\u0131lar\u0131n haz\u0131rlanmas\u0131 i\u00e7in bilinmekte olup, yayg\u0131n olarak kullan\u0131lmaktad\u0131rlar. D14 \u00f6rne\u011fin &#8220;Dynacoll\u00ae 7330&#8221; \u00fcr\u00fcn\u00fcn\u00fc tan\u0131mlamaktad\u0131r.<\/p>\n<p>Temyiz Kurulu yapt\u0131\u011f\u0131 incelemede BM 1460.002 numunesine ait bile\u015fimin, hem uygulamas\u0131 kolay hem de y\u0131kanmaya diren\u00e7li olma avantajlar\u0131n\u0131 sa\u011flamad\u0131\u011f\u0131 sonucuna varm\u0131\u015ft\u0131r. Bu nedenle bu kompozisyon i\u00e7in ay\u0131rt edici teknik \u00f6zelli\u011fin form\u00fcle edilen teknik problemin \u00e7\u00f6z\u00fcm\u00fcne katk\u0131da bulunmad\u0131\u011f\u0131 ve teknik problemin istem konusu t\u00fcm kapsam bak\u0131m\u0131ndan \u00e7\u00f6z\u00fclmedi\u011fi anla\u015f\u0131lm\u0131\u015ft\u0131r. Temyiz Kurulu bu nedenle teknik problemi alternatif bir yap\u0131\u015fkan kompozisyonun sa\u011flanmas\u0131 olarak revize etmektedir.<\/p>\n<p>Di\u011fer yandan \u0130tiraz Birimi taraf\u0131ndan 4. terditli talebe dayal\u0131 istemin muhafazas\u0131 karar\u0131 sadece patent sahibi taraf\u0131ndan temyiz edildi\u011finden ve\u00a0<strong><u>reformatio in peius<\/u><\/strong>\u00a0ilkesi gere\u011fi (<a href=\"https:\/\/www.epo.org\/law-practice\/case-law-appeals\/recent\/g920009ep1.html\">G 9\/92<\/a>\u00a0ve\u00a0<a href=\"https:\/\/www.epo.org\/law-practice\/case-law-appeals\/recent\/g930004ex1.html\">G 4\/93<\/a>) temyiz eden taraf\u0131n hukuki pozisyonu temyiz etmeseydi bulunaca\u011f\u0131 pozisyona g\u00f6re daha olumsuz bir pozisyona ta\u015f\u0131namayaca\u011f\u0131ndan temyiz reddedilmi\u015f fakat muhafaza edilen 4. terditli talebe ait ana istemin muhafazas\u0131 karar\u0131 onanm\u0131\u015ft\u0131r.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>EP 1 602 702\u00a0numaral\u0131 patent itiraz s\u0131ras\u0131nda 4. terditli talebe dayal\u0131 istem seti ile muhafaza edilmi\u015ftir.
