EP 2 157 732<\/a>\u00a0numaral\u0131 patent \u0130tiraz Birimi taraf\u0131ndan iptal edilmi\u015ftir. Patent EPC\u00a0Md. 123(2)<\/a>\u00a0alt\u0131nda kapsam a\u015f\u0131m\u0131 nedeniyle iptal edilmi\u015ftir.<\/p>\n

Temyiz s\u00fcrecinde temyiz sahibi E7 yay\u0131n\u0131n\u0131n itiraz s\u00fcrecine dahil edilmesine kar\u015f\u0131 \u00e7\u0131km\u0131\u015f ve E1\u2019nin dikkate al\u0131nmamas\u0131 gerekti\u011fini belirtmi\u015ftir. Ayn\u0131 zamanda iptal edilen patentin sahibi olan temyiz sahibi ayr\u0131ca E1\u2019in kamuya a\u00e7\u0131lm\u0131\u015f oldu\u011fu hususuna da itiraz etmi\u015f ve E1\u2019in kamuya a\u00e7\u0131lm\u0131\u015f kabul edilmemesi gerekti\u011fini \u00f6ne s\u00fcrm\u00fc\u015ft\u00fcr.<\/p>\n

Ana talebe konu ana istem a\u015fa\u011f\u0131da yer almaktad\u0131r:<\/p>\n

“A method of configuring a Process Control PC system, and in particular a Substation Automation SA system, with a plurality of Intelligent Electronic Devices IEDs connected to switches of an Ethernet switch-based communication network, and with a sender IED sending different messages including periodic multicast messages to different predetermined receiver IEDs the periodic multicast messages being forwarded by a switch of the communication network, comprising<\/p>\n

– retrieving, for each sender IED of the plurality of IEDs and for each message configured to be transmitted by said sender IED, from a configuration representation of the PC system comprising the logical data flow definitions, the receiver IEDs for which the message is destined, as well as a Virtual Local Area Network Identifier VLAN ID, and<\/p>\n

– assigning, for each receiver IED, the VLAN IDs of all the messages destined for this receiver IED to an edge port of a switch of the communication network to which this receiver IED is connected.”<\/p>\n

Yukar\u0131daki ana istemde yer alan \u201cconfiguration representation\u201d ifadesinin \u00f6n\u00fcnde yer alan \u201cstandardized\u201d ifadesi ba\u015fvuru sahibi taraf\u0131ndan inceleme s\u00fcreci s\u0131ras\u0131nda silinmi\u015ftir. Temyiz Kurulu bu silinme i\u015fleminin\u00a0T 331\/87<\/a>\u00a0karar\u0131nda tan\u0131mlanan \u00fc\u00e7 a\u015famal\u0131 testin en az\u0131ndan ikinci kriterini ihlal etti\u011fi g\u00f6r\u00fc\u015f\u00fcndedir:<\/p>\n

T 331\/87 test kriterlerine g\u00f6re bir istemden Md. 123(2) kapsam a\u015f\u0131m\u0131 ihlaline yol a\u00e7maks\u0131z\u0131n teknik unsur \u00e7\u0131karabilmek i\u00e7in:<\/p>\n

    \n
  1. \u00a0\u00e7\u0131kar\u0131lan unsurun asli unsur olmamas\u0131,<\/li>\n
  2. \u00e7\u0131kar\u0131lan unsurun tarifnamede asli unsur olarak zikredilmemi\u015f olmas\u0131 ve<\/li>\n
  3. geriye kalan unsurlarda \u00e7\u0131kar\u0131lan unsurun yoklu\u011funu telafi etmek amac\u0131yla de\u011fi\u015fiklik veya yeni unsur ekleme ihtiyac\u0131n\u0131n bulunmamas\u0131 gereklidir.<\/li>\n<\/ol>\n

    B\u00f6ylece Temyiz Kurulu \u201cstandardized\u201d ifadesinin inceleme s\u0131ras\u0131nda istemden \u00e7\u0131kar\u0131lmas\u0131n\u0131n istemde tan\u0131ml\u0131 uygun konfig\u00fcrasyonu sa\u011flamak i\u00e7in vazge\u00e7ilmez oldu\u011funu ve bu nedenle istemden \u00e7\u0131kar\u0131lmas\u0131n\u0131n orijinal kapsam\u0131n a\u015f\u0131lmas\u0131 ihlaline yol a\u00e7aca\u011f\u0131n\u0131 ifade etmektedir.<\/p>\n

    \u0130ptal edilen patentin sahibi olan temyiz sahibi E1\u2019in kamuya a\u00e7\u0131lm\u0131\u015f oldu\u011fu hususuna itiraz etmekle birlikte E1 mektubunun hitaben yaz\u0131ld\u0131\u011f\u0131 Bay H. Dawidczak mektubun kendisine herhangi bir gizli tutma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc olmaks\u0131z\u0131n iletildi\u011fini ve dolay\u0131s\u0131yla i\u00e7eri\u011finin gizli olabilece\u011fi konusunda bilgi sahibi olmad\u0131\u011f\u0131 ifade etmektedir. Di\u011fer yandan mektubun Bay H. Dawidczak ile birlikte 100\u2019e yak\u0131n farkl\u0131 al\u0131c\u0131ya herhangi bir gizlilik imas\u0131 olmaks\u0131z\u0131n ula\u015fmas\u0131 kamuya if\u015fa edildi\u011fi konusunda ku\u015fku b\u0131rakmamaktad\u0131r. Di\u011fer yandan patent sahibi if\u015faat\u0131n ger\u00e7ekle\u015fti\u011fi konusunda ispat k\u00fclfetinin itiraz sahibine ait oldu\u011funu ve ispat standard\u0131n\u0131n olas\u0131l\u0131klara dayal\u0131 de\u011fil son noktaya kadar ispat (up to the hilt) \u015feklinde olmas\u0131 gerekti\u011fini belirtmi\u015ftir. Temyiz Kurulu E1 mektubu sadece bir ki\u015fiye de\u011fil 100 kadar ki\u015fiye ula\u015ft\u0131\u011f\u0131ndan olas\u0131l\u0131klara dayal\u0131 normal ispat standard\u0131n\u0131 uygulamay\u0131 tercih etmi\u015ftir.<\/p>\n
